The Bombay High Court’s recent decision to convict Tarun Tejpal, the former editor-in-chief of Tehelka, has been met with approval from senior Goa Police officer Sunita Sawant. She expressed her support for the ruling in relation to the 2013 sexual assault case involving Tejpal, emphasising that the trial court had failed to adequately assess the evidence presented. Sawant noted that the State government felt compelled to challenge the previous acquittal, labelling the trial court’s verdict as “perverse”.

Speaking to reporters outside the court, Sawant highlighted that the acquittal needed to be overturned as it did not reflect the realities of the case. She reported that the High Court has commenced discussions regarding the quantum of the sentence, which is expected to be announced at 2:30 pm. Under Section 376 of the Indian Penal Code, the minimum penalty for such an offence is 10 years, while the maximum could be life imprisonment.

Sawant further remarked on the thorough nature of the investigation, asserting that all relevant evidence was diligently compiled and brought before the court. She described the investigation as particularly challenging but maintained that all findings were presented accurately to the judiciary.

Legal Representatives Respond to the Verdict

Goa Advocate General Devidas Pangam also expressed satisfaction with the Bombay High Court’s decision, describing it as a verdict rooted in justice and substantiated by evidence. He remarked that the ruling delivered much-needed reassurance to the survivor following a troubling acquittal by the trial court. Pangam pointed out that the lower court had made significant errors in its judgement regarding Tejpal’s acquittal despite existing evidence.

Pangam stated that the trial court’s decision ultimately misrepresented the victim’s character and did not adequately consider the compelling evidence available. He highlighted the existence of emails where Tejpal allegedly apologised, suggesting this evidence should have been pivotal in the court’s deliberations. He articulated that the High Court’s ruling reinstated trust in the justice system, particularly for the victim.

Highlighting the substantial evidence gathered against Tejpal, Pangam confirmed that clear documentation existed that substantiated the survivor’s claims. He lauded the efforts of the investigation team, the prosecution, and Solicitor General Tushar Mehta for their roles in challenging the earlier acquittal.

Background of the Case

The conviction of Tarun Tejpal comes in the context of allegations made by a female journalist who accused him of sexually assaulting her inside a hotel elevator on November 7 and 8, 2013. Tejpal was arrested on November 30, 2013, and was subsequently charged in September 2017 under several provisions of the Indian Penal Code, including rape and sexual harassment. He maintained his innocence throughout the proceedings.

After extensive legal proceedings, the Goa sessions court acquitted Tejpal of all charges in May 2021, concluding that the prosecution had not met the burden of proof required for a conviction. The lower court cited the lack of medical evidence and emphasized communications between Tejpal and the complainant, which it believed did not support the claims of trauma. Following this acquittal, the Goa government appealed to the Bombay High Court.

The High Court’s ruling, issued on August 6, 2023, overturned the earlier acquittal, with the court finding substantial flaws in the trial court’s evaluation of the evidence presented. The ongoing analysis of this case has highlighted critical issues surrounding sexual assault prosecutions in India, reinforcing the significance of judicial scrutiny in such serious matters.
