Supreme Court Orders SIT Investigation Into Ghaziabad Child’s Sexual Assault and Murder

The Supreme Court has mandated the formation of a Special Investigation Team (SIT) to examine the alleged sexual assault and murder of a four-year-old girl in Ghaziabad. This decision was made during a hearing on April 24, where Chief Justice Surya Kant led a bench that underscored the need for a focused inquiry into the tragic incident.

The SIT will consist of three women police officers, with specific ranks and qualifications. The team will include a woman officer at the level of Commissioner or Inspector General, preferably from the Uttar Pradesh police cadre but without local connections. Additionally, a second officer must hold at least the rank of Superintendent of Police or Deputy Superintendent of Police, while the third team member will be an officer of the rank of Deputy Superintendent or Inspector.

The Supreme Court has directed that the SIT be established either on the same day or by a deadline of 11 pm on April 25. The immediate commencement of the investigation is emphasised, given the severe concerns raised regarding the initial handling of the case and the alleged ineffectiveness of prior inquiries.

SIT’s Mandate and Focus Areas

The court has specified that the SIT’s investigation will address multiple aspects concerning the case. Notably, the team is to look into the actions of two private hospitals that reportedly refused to provide medical care to the child during a critical timeframe, even while she was still alive. This facet of the investigation has raised significant alarm among the victim’s family, who believe that timely medical assistance could have potentially saved her life.

Furthermore, the court has instructed the SIT to explore the conduct of officials involved in the initial investigation, raising concerns about purported mishandling of the probe. The court has also made it clear that all grievances expressed by the child’s parents must be adequately addressed, including safeguarding key witnesses who may contribute to the investigation.

To ensure that the investigation is conducted impartially, the trial court has been directed to postpone any ongoing proceedings until the SIT completes its supplementary report. This decision aims to facilitate a thorough and transparent examination of the events surrounding the case, which has drawn significant public interest and scrutiny.

Context of the Case and Police Conduct Under Review

The background of this case involves the alleged rape and murder of the four-year-old victim, which reportedly occurred in the Nandnagri area of Ghaziabad on March 17. The circumstances surrounding the incident and the police response have faced intensive analysis, prompting the Supreme Court to intervene.

During a prior session on April 13, the Chief Justice expressed skepticism regarding the motivations of the Ghaziabad police in managing their investigation. Concerns highlighted included a perceived reluctance to pursue leads and conduct a robust inquiry into the horrific allegations raised.

In a related development, the Additional Solicitor General, Aishwarya Bhati, representing the Ghaziabad police, informed the court that a fresh chargesheet had been filed, which included allegations of rape under the revised Indian Penal Code (IPC) and aggravated penetrative sexual assault under the Protection of Children from Sexual Offences (POCSO) Act. However, the Supreme Court emphasized the need to scrutinise the conduct of police officials before determining further investigative steps.
