Decades-Old Dargah in Mumbai Demolished Due to Legal Issues

The CSR Journal Magazine

The Brihanmumbai Municipal Corporation (BMC) demolished the Barkat Ali Shah Baba Dargah on Tuesday, following a decision based on alleged legal deficiencies relating to the structure. The action, conducted under strict security measures, included a significant presence of police personnel. This dargah, situated approximately 400 metres from the Aarey police station, had a complex history that included a previous demolition in 2017, only to be reconstructed the following year.

Motivation Behind The Demolition

The initiative for the demolition was reportedly sparked by a visit from BJP leader and former MP Kirit Somaiya, who advocated for the dismantling of the dargah. His assertion was that the structure had allegedly been built on land meant for the Maharashtra government’s dairy development project. Following his visit, Somaiya took to the social media platform X to express his views, stating that the illegal construction had been addressed.

In the early hours of the demolition, a convoy of bulldozers and cranes was dispatched to the site, marking the commencement of the operation. The adjoining area was restricted to the public, ensuring that no disruptions occurred during the process. This precaution was particularly relevant in light of a prior incident in Bandra Garib Nagar, where authorities faced hostility during a similar demolition. Despite concerns regarding potential unrest, the operation proceeded without incident, with the police able to maintain order effectively.

The demolition was the culmination of prior warnings issued to the dargah authorities, who were given a deadline to validate the legality of their establishment. However, when they failed to present any legal documents to the BMC, it led to the inevitable decision to proceed with the demolition.

Additional Context On Anti-Encroachment Drives

In the same week, the BMC also undertook a demolition of an illegally constructed temple located in Dindoshi, highlighting the ongoing efforts by the municipality to regulate unlawful structures across Mumbai. These actions form part of BMC’s routine anti-encroachment campaigns carried out before the monsoon season, aimed at maintaining compliance with urban regulations and ensuring public safety.

The routine practice of demolishing illegal constructions has elicited mixed reactions from various community groups within the city. Still, the BMC maintains that such measures are essential to uphold the law and protect designated land uses against encroachment. Officials have reiterated their commitment to ensure that no more structures arise without appropriate legal backing.

Demolitions such as this one serve to illustrate the ongoing tensions surrounding land use and regulation within the urban landscape of Mumbai. The BMC has expressed its determination to continue these operations as part of its broader mandate to preserve the integrity of land designated for public projects and avoid congestion in growing urban areas.
