Supreme Court of India Restores Life Sentence of Kuldeep Singh Sengar, Orders Fresh Appeal Review

The Supreme Court has annulled a Delhi High Court ruling that had previously suspended the life sentence of former BJP MLA Kuldeep Singh Sengar in connection with the 2017 Unnao rape incident. This decision was announced by a bench led by Chief Justice of India Surya Kant along with Justice Joymalya Bagchi on a Friday. The top court instructed the High Court to reassess Sengar’s plea regarding his conviction and life sentence, with the expectation that new arguments would be evaluated without any influence from previous observations made by the Supreme Court.

The Supreme Court has set a two-month deadline for the High Court to make a decision on Sengar’s main appeal against his conviction and sentence. Should the High Court find it challenging to reach a conclusion within this timeframe, it is required to issue a ruling on Sengar’s application seeking suspension of his life sentence prior to the summer recess.

Furthermore, the Supreme Court clarified that it was not indicating any view concerning the merit of the case and affirmed that the High Court has the liberty to proceed with a fresh evaluation. The Chief Justice also highlighted the necessity for the High Court to deliberate on whether an MLA qualifies as a public servant under the Protection of Children from Sexual Offences Act for the purpose of prosecution.

The Delhi High Court’s judgement on December 23, 2025, acknowledged Sengar’s conviction under Section 5(c) of the POCSO Act, which addresses aggravated penetrative sexual assault by a public servant. However, the court had concluded that an elected representative does not fall under the definition of a public servant per Section 21 of the Indian Penal Code. This ruling resulted in the suspension of Sengar’s imprisonment while his appeal was pending, taking into account that he had already served seven years and five months behind bars.
