Supreme Court Calls Homemakers ‘Nation Builders’, Recognises Economic Value of Unpaid Domestic Work

The Supreme Court has made a substantial ruling, asserting that the term “homemaker” inadequately represents the contributions of women managing households. The court noted that these women’s roles extend far beyond traditional domestic duties, primarily contributing to family development, nurturing future generations, and promoting national progress. A bench led by Justice Sanjay Karol observed that the domestic work and caregiving provided by these women possess undeniable economic value, playing a vital role in the upbringing of children and the overall enhancement of human development.

The court emphatically stated, “Instead of calling her a homemaker, she should be called a nation builder,” reinforcing the idea that the contributions of women within their homes significantly impact society at large. This judgement was passed while the court established guidelines for calculating compensation in cases related to the accidental deaths of homemakers.

Gender Roles and Marriage Clarified

In an important commentary on marriage dynamics, the Supreme Court clarified that the responsibilities within this institution should not singularly rest on women. The bench asserted that marriage should not be regarded as a scenario where a woman is expected to bear the entire burden of household work. It remarked, “Marriage does not mean hiring a maid,” highlighting that domestic responsibilities should be equally shared by both partners.

The bench further emphasised that a woman’s aspirations and professional goals should not be compromised due to marital status. If a woman desires to pursue a career—be it in medicine or another field—while maintaining a nurturing environment for her children, such choices should not be regarded as neglectful towards her husband or in-laws. The court concluded that “a woman’s identity does not end after marriage,” affirming the need for equitable recognition of women’s roles.

Additionally, the ruling acknowledged the personal sacrifices made by homemakers, which often go unrecognised. The court stated that women dedicating their time and energy to familial responsibilities play a crucial role in stabilising family wealth and deserve appropriate societal and economic recognition.

Value of Unpaid Domestic Labour Highlighted

The Supreme Court underscored that unpaid domestic labour has historically been overlooked in traditional economic evaluations, despite its essential contribution to families and society. The bench noted that a homemaker’s role is not limited to cooking or cleaning, as it encompasses child-rearing, value development, family support, and societal shaping. Such efforts contribute significantly to human resource development and, consequently, national advancement. The court insisted that the economic value of the domestic work and caregiving offered by homemakers must be acknowledged.

In conjunction with its broader observations, the court introduced new guidelines for determining compensation in motor accident cases involving homemakers. It stated that compensation assessments should incorporate not just financial loss but also the value of lost domestic care and services for the family. The defined value for “loss of domestic care” was set at Rs 30,000 per month, which will serve as an additional metric for compensation calculations in future assessments.

The court’s directive also indicated that future contributions of homemakers should be factored into compensation awards to reflect their enduring role in family welfare and social growth. Furthermore, Chief Justices of all High Courts were instructed to ensure timely handling of motor accident compensation cases, preventing lengthy judicial delays.
