Press Freedom Is Not a License for Sensationalism: Delhi High Court

The Delhi High Court has stated that while press freedom is a critical component of democracy, it cannot be used to defend irresponsible journalism. The remarks were made during the bail hearing for two individuals accused of assaulting freelance YouTube reporters. The court underscored the need for a regulatory framework that promotes press freedom while ensuring ethical standards and professional accountability.

Justice Girish Kathpalia remarked that the rapid expansion of social media has resulted in many unregulated individuals claiming to be journalists. He noted that anyone equipped with a mobile device can label themselves as a reporter, often lacking any formal journalistic training. This trend has compromised the standards of journalism and risks the dissemination of misleading information.

The court pointed to the growing habit of so-called reporters aggressively seeking quick soundbites from citizens. It stated that if a person opts not to respond, these reporters frequently misrepresent such silence as an evasion, thereby creating a distorted narrative in the public domain. The justice highlighted the potential dangers of this behaviour and its implications for public discourse.

Bail Hearing for Alleged Attackers

The bail application for Abid Ali and Furkan, who have been in custody since July 5, 2025, was considered amidst these discussions about the role of journalism. They are charged with assaulting two freelance YouTube reporters in an unauthorised area of Seemapuri. The incident reportedly involved a mob that attacked the reporters and damaged their equipment.

The High Court expressed significant dissatisfaction with the conduct of the investigating agency. Justice Kathpalia highlighted that the Investigating Officer and Station House Officer had failed to provide effective assistance during the bail hearings. He pointed out that procedural delays in the investigation have extended the custody of the accused without the commencement of a trial, which he described as unacceptable.

Inconsistencies in the prosecution’s case also drew the court’s attention. Initially, the Investigating Officer claimed that one of the accused had assaulted the complainants. However, this assertion was contradicted when a video evidence was reviewed in court. Furthermore, there were discrepancies in identifying one of the accused, with conflicting descriptions provided at different stages of the legal proceedings.

Importance of Media Accountability

While granting bail, the High Court noted that the complainants were not accredited journalists but were freelancing for a YouTube channel. It acknowledged that although the alleged attack on them could be viewed as an assault on press freedom, the lack of prior communication with local authorities regarding their activities diminished their status as victims in this context. The Court asserted that no prior notice, however, could justify violence against them by local residents.

The court’s ruling clarified that its observations regarding the necessity for a regulatory framework were specific to the bail applications. The trial court is expected to evaluate the evidence independently, free from influences arising from the current proceedings. The remarks made during this bail hearing, while pointing out the issues in reporting practices, will not dictate future deliberations of the trial.

In conclusion, the High Court reiterated the essential balance that must be maintained between safeguarding press freedom and ensuring accountability. It called for careful consideration by legislative bodies to establish regulations that protect the rights of journalists and the public interest simultaneously.
