Nashik TCS Case Reveals Allegations of Coercive Religious Manipulation

The CSR Journal Magazine

The chargesheet concerning the alleged sexual harassment and forcible conversion case involving TCS in Nashik has unveiled claims of a deliberate scheme targeting the victim. A 23-year-old employee reported that she was compelled to view videos featuring Islamic clerics Tariq Jamil from Pakistan and Indian preacher Zakir Naik. The purpose of showing these videos was reportedly to educate the victim about Islam.

In her statement included in the chargesheet filed in a Nashik court last week, the victim detailed how she was subjected to systematic psychological manipulation by the accused. Under the pretext of alleviating her “mental stress,” the manipulation allegedly exploited her vulnerabilities. The victim expressed that she was led to believe that converting to Islam would offer her relief from her distress.

The case was initiated at the Deolali camp police station, following the victim’s complaint. Alongside three arrested individuals, Danish Shaikh, Tausif Attar, and Nida Khan, the chargesheet names AIMIM corporator Matin Patel as an accused for allegedly harbouring Nida Khan during her time in hiding. The document states Patel provided shelter to Khan despite knowing her anticipatory bail was denied.

Involvement of Multiple Individuals

The accusations against Matin Patel include obstructing the law by allegedly concealing Khan’s location when police sought her. Despite initially deflecting inquiries about her whereabouts, Patel ultimately disclosed the details of where he sheltered Khan, as per the chargesheet.

The allegations detail a supposed campaign of religious and psychological coercion by the trio, targeting the victim. It has been emphasised in her statement that Danish Shaikh, who is reportedly married, exploited her sexually under the guise of a future marriage, assuring her that her mental stress would decrease if she converted to Islam.

The victim recounted Sheikh informing her to cease listening to devotional songs and visiting temples, stating that, “Trust me, Allah is with us.” Following this, he advised her to engage in specific religious practices, including reciting prayers that he claimed would alleviate her worries.

Wider Allegations and Company Response

Significantly, while the Deolali Camp police station registered a single case, multiple FIRs have been lodged at the Mumbai Naka police station. Employees have voiced claims of being pressured into changing their dietary habits and adopting different religious practices, leading to substantial concern over workplace culture. TCS has reiterated its zero-tolerance policy towards any form of harassment, having suspended the employees allegedly involved in the incidents.

Further to the allegations, the victim noted that Sheikh had instructed her to view the videos of Tariq Jamil and other Islamic figures. He allegedly collected significant personal details from her, including banking information. She mentioned that he then tasked his associates, Tausif and Nida, with providing her religious instruction and encouraging her to research more on Islam.

The victim’s exposure included various aspects of Islamic theology, and she expressed her growing conviction that adopting the religion would ease her mental struggles. She reportedly began to believe in the narratives shared with her about the religion.

The chargesheet includes testimonies from 106 witnesses, comprising family members, TCS colleagues, and members from the Prevention of Sexual Harassment (POSH) committee. In response to the mounting testimonies from female employees alleging exploitation, coercive practices, and mental harassment, the Maharashtra government constituted a Special Investigation Team to delve into the allegations.
