Devotees Pray at Bhojshala Complex Following Madhya Pradesh HC Ruling

The recent ruling from the Indore Bench of the Madhya Pradesh High Court has led devotees to enter the Bhojshala complex in Dhar district to offer prayers. On Saturday, May 16, 2023, following the verdict, the site was recognised as a temple dedicated to Goddess Vagdevi. This designation has restored worship rights to the Hindu community at the disputed Bhojshala-Kamal Maula complex.

According to reports, individuals gathered within the premises to engage in prayers after the court’s decision. One devotee expressed gratitude for the ruling, stating that for the first time in years, they could worship without limitations at the revered site. The sentiments of this devotee echoed the relief felt among many as they began to visit the complex again.

The court’s decision confirmed the long-held belief among the Hindu community that the site, which dates back to the Bhoj-Parmar dynasty, is fundamentally a temple. The ruling has significantly modified previous stipulations regarding worship rights at the location.

ASI’s Role and Legal Framework

The legal ramifications of the ruling include the designation of the Bhojshala site as a “Protected Monument,” a status it has held since 1904. Aviral Vikas Khare, representing the Archaeological Survey of India (ASI), clarified that the administration and regulation of the site will remain solely under the ASI. The implications of this arrangement ensure that the site’s supervision will be managed exclusively by this institution.

The court highlighted the historical significance of the complex, underscoring that it is the site of a temple dedicated to Vagdevi, known as Goddess Saraswati. This claim has been a central point in the disputes surrounding worship rights at Bhojshala. The ruling also overturned a previous ASI order that allowed limited Muslim worship within the site on specific days.

In the context of the court’s decision, the interests of both communities are being acknowledged. The ruling has modified earlier arrangements that permitted the Muslim community to conduct prayers within the complex. Legal representatives have noted that this change reflects a balance in the conflicting rights and historical claims over the site.

Future Legal Considerations and Challenges

Despite the current legal environment, the state authorities had previously established a shared arrangement for worship at the Bhojshala complex. This arrangement was made while the site remained under ASI supervision, which conducted comprehensive surveys of the area in question.

The advocate representing the Hindu side characterised the ruling as a “historic” judgement, emphasising its significance in recognition of the site’s identity and rights. Furthermore, discussions have emerged regarding the repatriation of an idol currently housed in a museum in London, indicating ongoing legal dialogues surrounding artefacts linked to cultural heritage.
