Trinamool Congress Challenges Appointment of Ritabrata Banerjee as Leader of Opposition

The Trinamool Congress (TMC) has initiated legal proceedings against the West Bengal Assembly Speaker’s appointment of Ritabrata Banerjee as the Leader of Opposition (LoP). On Thursday, TMC representative Sobhandeb Chattopadhyay presented the case before the Calcutta High Court, asserting that the Speaker’s decision undermines the fundamental structure of the Constitution.

Senior advocate Kalyan Banerjee, representing Chattopadhyay, stated that the TMC had formally informed the Speaker about its choice to appoint Chattopadhyay as the LoP. He emphasised that the authority to appoint such a position rests solely with the political party rather than the legislative faction, arguing that the Speaker is obligated to respect the party’s designation.

Banerjee claimed that the Speaker’s actions contravene constitutional principles, impacting the legitimacy of opposition representation within the State Assembly. The ongoing legal dispute concerns the authority residing with the political entity to dictate its leadership roles, thus raising critical constitutional questions.

Challenge to Breakaway Group’s Recognition

Alongside the challenge to Ritabrata Banerjee’s appointment, the petitioners, including Chattopadhyay and TMC chairperson Mamata Banerjee, are contesting the Speaker’s recognition of Sandipan Saha as the Chief Whip for the breakaway faction led by Banerjee. This group claims alleged support from 57 additional TMC MLAs.

Kalyan Banerjee, while arguing for an interim stay on the Speaker’s ruling, noted the Assembly is set to reconvene on June 18. He raised concerns regarding the legitimacy of recognising leaders from a faction that has purportedly diverged from the original party structure.

Counsel for the Speaker, Billwadal Bhattacharya, requested additional time to prepare a response to the claims made in the petition. The High Court did not issue an interim ruling and has scheduled the next hearing for June 16, allowing for all parties to present their arguments.

Historical Context of the Leader of Opposition Appointment

Kalyan Banerjee also referenced historical practices regarding the appointment of the Leader of Opposition within West Bengal, asserting that traditionally, the Speaker has appointed a nominee directly endorsed by the political party rather than merely acknowledging the legislative faction. This approach, he argued, preserves the integrity and representation of the opposition party in governance.

He highlighted that Mamata Banerjee, as the founder chairperson of the TMC, leads the largest opposition group in the current Assembly, which secured 80 seats in the most recent election held in May. The lawyer stressed that departure from this established practice would diminish the representation of the party’s true leadership.

Furthermore, Kalyan Banerjee indicated that both Ritabrata Banerjee and Sandipan Saha had been expelled from the TMC, calling for the breakaway faction to be classified as a “group” rather than an official “legislature party.” The TMC’s assertion lays the groundwork for their argument that party cohesion and recognition as a legitimate leadership structure rest with the original political party.
