Sonam Wangchuk, a climate activist, was moved from Safdarjung Hospital to Medanta Hospital on July 21, following directives from the Delhi High Court. The court ordered the immediate transfer after Wangchuk’s wife, Gitanjali Angmo, submitted an appeal. The Division Bench, comprising Chief Justice Devendra Kumar Upadhyaya and Justice Tejas Karia, carefully reviewed the situation before making the ruling.

Medical Recommendations Considered

As part of the proceedings, the High Court took into account medical recommendations indicating that Wangchuk required constant monitoring in a hospital setting. The solicited views recognised that he needed appropriate care that could adequately address his current health conditions. The court directed Wangchuk to follow the medical advice provided by the doctors at Medanta Hospital.

During the hearing, Senior Advocate Akhil Sibal, representing Angmo, highlighted that Wangchuk’s vital signs were stable, citing that he was maintaining oral rehydration while persisting with his hunger strike. Moreover, Sibal brought forth a letter from Wangchuk, alleging police surveillance within Safdarjung Hospital and restrictions on his mobile phone usage. This letter expressed concerns that the court deemed necessary to evaluate against the consensus reached by medical practitioners.

Solicitor General Tushar Mehta conveyed that the Centre did not object to the transfer, acknowledging Medanta as a reputable institution. However, he underscored the necessity for Wangchuk to remain under continuous medical supervision and not to leave the hospital contrary to medical advice. Mehta reiterated that any discharge decision should be made exclusively by the medical team at Medanta, not by Wangchuk himself.

Post-Transfer Care and Management

The court stressed the importance of continuity in Wangchuk’s care, instructing that all medical documents from Safdarjung Hospital, encompassing investigation reports and treatment records, be transferred to Medanta. This arrangement aims to ensure that Wangchuk receives consistent and comprehensive care during this critical time.

Following the transfer order, the Division Bench concluded the appeal that contested a previous Single Judge’s decision, which denied Wangchuk the opportunity to move to a private medical facility of his choice. Wangchuk has been on an indefinite hunger strike since June 28, protesting against alleged irregularities in examinations and issues surrounding the NEET-UG paper leak. He was initially taken to Safdarjung Hospital by law enforcement on July 17.
