This comes a day after the Lok Sabha approved the bill, which aims to enhance the legal framework for addressing incidents of paper leaks during examinations. The debate is scheduled to begin at 2 pm and is expected to last for approximately seven hours.

Details of Legislative Debate

During the Lok Sabha’s session, the Public Examination (Prevention of Unfair Means) Amendment Bill was passed following a brief response from Union Minister Jitendra Singh. He reportedly directed criticism towards Congress leader Rahul Gandhi, alleging inappropriate language usage and questioning his understanding of essential parliamentary conventions. The initial discussions began at 2 pm on Tuesday and continued until late at night, later resuming on Wednesday.

The amendment proposes significant changes to the current legal provisions, notably increasing the minimum imprisonment term for individuals found guilty of employing unfair means in examinations from three years to five years. Moreover, the maximum term would now be set at ten years, as opposed to the previous five years.

In addition to altering the jail terms, the bill suggests raising the maximum financial penalty from Rs 10 lakh to Rs 50 lakh for those committing such offences. It also introduces stricter penalties for service providers involved in similar activities, proposing a maximum fine of Rs 5 crore, alongside extending the debarment period from four years to eight years for those found guilty of misconduct.

Implications of Organised Examination Crimes

The bill outlines enhanced measures for addressing organised crime associated with examination fraud. The proposed amendments include raising the minimum term of imprisonment from five years to seven years for serious offences, while also elevating the upper fine limit from Rs 1 crore to Rs 10 crore. Such measures indicate the government’s commitment to curbing corruption in public examination systems.

Moreover, the legislation empowers the central government to establish a Special Task Force tasked with investigating paper leak incidents and other related offences. A new provision, Section 12A, mandates the completion of investigations within two months of the incident, streamlining the process of legal accountability.

The bill also aims to designate Courts of Session as Special Fast Track Courts to expedite the trial processes related to these offences. Trials are to be concluded within three months from the date of the charge sheet’s filing, ensuring swift justice is delivered. In conjunction, the appointment of Special Public Prosecutors for each Fast Track Court aims to facilitate a focused approach in handling these cases efficiently.
