Punjab CM Bhagwant Mann Proposes 10-Day Parole for Jagtar Singh Hawara

Punjab Chief Minister Bhagwant Singh Mann recently met with the state Governor to discuss the potential for a 10-day parole for Jagtar Singh Hawara. This recommendation is grounded in concerns for Hawara’s mother’s health, which has reportedly worsened over time. CM Mann emphasised the humanitarian grounds for this request, highlighting that Hawara has not seen his mother for over three decades due to his incarceration.

Following the meeting, CM Mann addressed the media, elaborating on the reasoning behind the parole recommendation. He stated that allowing Hawara to visit his mother would fulfil her wish to see him after many years apart. The emotional context of the situation was stressed to underline the dire circumstances of his mother’s deteriorating condition.

Hawara is currently serving a life sentence for his alleged involvement in the assassination of Punjab’s former Chief Minister Beant Singh in 1995. The Chief Minister’s recommendations serve to bring this matter to the forefront, given that the case is subject to hearings in the Union Territory.

Governor’s Role and Administrative Procedures

During his remarks, CM Mann noted the importance of the Governor’s role in advocating for the parole request. He clarified that as the case is under review in the Union Territory, the Governor will contribute significantly in forwarding the request to the Central Government. The decision ultimately lies with the Central authorities, but CM Mann expressed confidence in the process.

Security concerns have been raised surrounding the parole request; however, CM Mann reassured the administration about maintaining public order. He indicated that he provided formal assurances to the Governor regarding the management of the situation, stating that measures would be in place to ensure that no disturbances arise in the community.

According to CM Mann, the Governor has responded positively and expressed a commitment to hastening the bureaucratic procedures necessary for the parole to be granted. The communication between the Governor and the Home Secretary of the Government of India is reportedly set to occur soon to facilitate this process.

Legal Context and Previous Correspondence

Prior to the meeting with the Governor, CM Mann had taken steps to formally review the request by sending a letter to Governor Gulab Chand Kataria on August 9. In the correspondence, he highlighted the reasons for the parole application based on humanitarian considerations, specifically citing issues related to age and health affecting Hawara’s mother.

Moreover, it was mentioned that Jagtar Singh Hawara has filed a petition in the Punjab and Haryana High Court seeking a directive for his release on parole. The High Court has advised that his application should be considered, further reinforcing the legal framework within which this request is being made.

Given these developments, the Chief Minister has urged that the parole be granted promptly. The communication emphasises not only the legal but also the moral imperatives involved in the case, illustrating the weight of personal circumstances in judicial considerations.
