Musk Under Fire In OpenAI Trial As Judge Rejects ‘Existential Risk’ Arguments

The ongoing trial involving Elon Musk and OpenAI has reached its third day, marked by heightened courtroom tensions. Judge Gonzalez Rogers conveyed her impatience with Musk’s persistent warnings about artificial intelligence posing an existential threat to human existence. Prior to Musk returning to the witness stand for further questioning, the judge instructed Musk’s legal counsel to refrain from discussing the alleged dangers presented by AI.

While Musk’s attorney, Steven Molo, engaged in a contentious exchange with OpenAI’s lawyer, the judge intervened, labelling the debate as trivial. She stated, “I suspect that there are a number of people who do not want to put the future of humanity in Mr. Musk’s hands,” while urging both sides to focus on more pertinent issues.

This development could significantly undermine Musk’s position, as his legal team has emphasised the existential risks they attribute to artificial intelligence, claiming they aim to safeguard humanity from potential threats emanating from OpenAI’s advancements.

Contradictions Emerge During Testimony

Latter portions of the day featured a cross-examination by OpenAI’s primary attorney, William Savitt, who employed a strategy focused on challenging Musk’s credibility. Savitt presented a video of Musk’s pre-trial deposition, which allegedly conflicted with Musk’s testimony from the previous day.

In his deposition, Musk had stated that he had not reviewed a significant document related to OpenAI. However, upon questioning on Thursday, he admitted to having read at least part of this document, much to Savitt’s satisfaction. The attorney spent considerable time juxtaposing Musk’s courtroom assertions with his earlier statements, causing Musk’s irritation to escalate with every contradiction revealed.

Additionally, Savitt probed whether Musk had influenced the algorithm managing his social media platform, X, to boost his account visibility. Musk denied having done so, indicating the minutiae of this inquiry were part of an overarching strategy to undermine his credibility.

xAI Training Methods Under Scrutiny

During his testimony, Musk suggested that xAI, his artificial intelligence lab, may have utilised OpenAI’s models in its training processes. In response to questioning from Savitt, Musk stated that “generally all the AI companies [do that],” when asked about the distillation of OpenAI’s models.

This line of inquiry correlated with questions posed by Russell Cohen, Microsoft’s lead counsel, who sought to illustrate that Musk’s litigation was initiated only after competition within the artificial intelligence sector intensified. Meanwhile, Musk’s legal representatives called for a witness, Jared Birchall, who oversees Musk’s financial interests, to testify regarding Musk’s financial donations to OpenAI.

Birchall’s testimony contributed to the trial’s evolving focus on the financial and legal implications surrounding the case. Musk has alleged that OpenAI and its co-founders breached their foundational contract by accepting large investments from Microsoft and pursuing commercial products.

Musk Seeks Substantial Damages

The trial, set to unfold over a month in federal court in Oakland, California, has Musk pursuing Rs 1 lakh crore in damages. He is also demanding a court order compelling OpenAI to reverse its transition to a for-profit entity, which occurred last year. Furthermore, Musk seeks the removal of Sam Altman from the board of directors of OpenAI.

As proceedings continue, the attention on this high-stakes legal battle is expected to intensify, with both sides presenting critical arguments regarding the future of artificial intelligence and its impact on society. The unfolding developments could have far-reaching consequences for the technology sector and its regulatory framework.
