This consideration arose during a court hearing where Pandey alleged that his facial expressions and teaching style had been exploited in online stickers and GIFs without his consent. Justice Anup Jairam Bhambhani made it clear that while the court may act to safeguard Pandey’s rights, any order should respect the right to free speech.

Details of the Allegations

Pandey’s legal representative, Senior Advocate J Sai Deepak, outlined the scope of the alleged infringement. He stated that numerous stickers and GIFs featuring Pandey’s image are being commercially leveraged online, with some containing objectionable content, including vulgar and derogatory material. Deepak highlighted the potential harm to Pandey’s reputation as an educator, asserting that this misuse could adversely impact how his students perceive him.

The court acknowledged Deepak’s concerns, noting the existence of varied content in the online materials. Some of it may be deemed acceptable, while other elements could be inappropriate or objectionable. The judge remarked that a blanket order was unfeasible due to the mix of legitimate and problematic content under scrutiny.

In response to the allegations, Justice Bhambhani urged the need to define personality rights clearly, indicating that precise classification would assist the court in making an informed decision. Before any orders can be issued, the court instructed the plaintiff to present a detailed classification of the alleged violations into three distinct categories: the commercial use of Pandey’s likeness, vulgar or explicit content extending beyond parody, and materials that may be defamatory.

Next Steps in Legal Proceedings

The court has not yet issued any formal notice or summons in connection with the matter. Justice Bhambhani mentioned that no further action would be taken until the requested categorisation is submitted. The hearing is scheduled to continue on August 5, when the court will likely deliberate on a specific course of action based on the new information provided.

Pandey, who launched PhysicsWallah initially as a YouTube channel in 2016, has seen his platform evolve into a prominent edtech entity in India. The channel provides educational resources for students preparing for various examinations such as JEE, NEET, and CBSE, amassing millions of subscribers nationwide.
