Calcutta High Court Declines Interim Order on Speaker’s Choice of Ritabrata Banerjee as Leader of Opposition

The Calcutta High Court has announced that it will not issue an interim order regarding the Speaker’s appointment of Ritabrata Banerjee as Leader of the Opposition (LoP) in the West Bengal Assembly. This decision was made on June 18, when Justice Krishna Rao mandated the involved parties to submit an affidavit opposing the Speaker’s decision within three weeks, followed by a two-week period for replies. The next hearing is scheduled for July 28.

According to the court’s directive, the Speaker’s decision remains in effect throughout this judicial process. Banerjee, previously expelled from the Trinamool Congress (TMC), was designated as LoP by Speaker Rathindra Bose amidst ongoing internal tensions within the TMC.

Political Developments Within TMC

The situation within the TMC has been marked by significant dissent, with a faction comprising 58 MLAs distancing themselves from the main party, effectively aligning as a separate entity in the West Bengal Assembly. This division has raised questions about the party’s internal cohesion and the challenges it faces in maintaining unity.

Adding to the political complexity, in the Lok Sabha, approximately two-thirds of TMC Members of Parliament, led by Kakoli Ghosh Dastidar, have reportedly merged with the Nationalist Citizens Party of India (NCPI) based in Tripura. They have also requested a distinct seating arrangement in the lower house from Lok Sabha Speaker Om Birla.

The ramifications of these developments could significantly affect the balance of power within West Bengal’s political landscape, as factions vie for influence and control.

Ritabrata Banerjee Advocates for Floor Test

In light of the turbulent political scenario, Ritabrata Banerjee has publicly supported the implementation of a floor test in the West Bengal Assembly. This recommendation aims to resolve ongoing uncertainties surrounding the stability and legitimacy of various factions within the assembly. Banerjee believes that such a test could clarify the actual strength of legislators and silence ongoing disputes.

Expressing his thoughts, Banerjee suggested that if the Speaker considers it pertinent, a floor test should be conducted to effectively establish the standing of the members. He noted that frequent statements made by political figures and media coverage of the situation have exacerbated uncertainty and debate.

Banerjee further emphasised that conducting a floor test would alleviate what he described as incessant rhetoric and counter-claims circulating in political discourse. His call for clarity reflects a desire amongst some political members for resolution and stability in an increasingly fragmented political environment.
