The Lok Sabha has officially approved the Public Examinations (Prevention of Unfair Means) Amendment Bill, 2026, demonstrating its commitment to enhancing the legal framework that governs public examinations in India. The passage of this bill occurred on July 30, following an intensive debate among lawmakers. The amendments aim to erect stronger barriers against examination malpractices, thereby protecting the interests of students and youth across the nation.

Key Features of the Amendment Bill

Union Minister of State for Science and Technology, Jitendra Singh, outlined several important features of the newly passed legislation. Among the most significant changes is an increase in the penalty for individuals caught employing unfair means during examinations. The potential imprisonment for these offences has been escalated from three to five years to five to ten years. Additionally, the maximum monetary fine imposed on offenders has been raised significantly from ₹10 lakh to ₹50 lakh.

For service providers complicit in such actions, the maximum fine has seen a dramatic increase from ₹1 crore to ₹5 crore, and the period during which they can be banned from conducting public examinations has been extended from four years to eight years. Moreover, the severity of punishment for directors and senior management in service organisations has been enhanced to match the harsher penalties facing individual offenders.

The amendments also bolster the penalties for organised crime related to examination fraud. The incarceration period is now set at seven to ten years, and fines have surged from ₹1 crore to ₹10 crore. These increases aim to deter potential wrongdoers and reassure the public about the government’s resolve to maintain examination integrity.

Establishment of Fast Track Courts

In an effort to ensure timely justice related to examination-related offences, the Amendment Bill proposes the establishment of Special Fast Track Courts. It anticipates that investigations will be completed within two months, and trials will conclude within three months of filing a charge sheet. This initiative aims to expedite the legal process concerning public examinations significantly.

Furthermore, the bill calls for appointing Special Public Prosecutors to handle these specific cases. It empowers the Government to form a Special Task Force dedicated to investigating offences under the Act, thus reinforcing the capacity to address and mitigate organised crime related to examinations effectively.

Singh also referenced the Prime Minister’s initiative to create a high-level task force composed of distinguished experts tasked with making the public examination framework “leak-proof.” This indicates a broader strategy to enhance the entire examination system and reinforce its credibility.

Commitment to Transparency and Action

Since the enactment of the Public Examinations (Prevention of Unfair Means) Act in 2024, 52 First Information Reports (FIRs) have been registered. This highlights the government’s active commitment to stringent enforcement against examination misconduct. The amendments are designed to ensure that genuine and deserving students receive recognition for their honest efforts while simultaneously penalising those engaged in organised examination fraud.
