Bihar BJP MLA Sentenced to Four Years in Prison in 2018 Firing Incident

A Delhi court has sentenced Raju Kumar Singh, a Member of the Bihar Legislative Assembly representing the Bharatiya Janata Party (BJP), to a four-year prison term. This ruling comes in relation to a celebratory firing incident that occurred in 2018, resulting in the tragic death of a woman doctor. The Rouse Avenue Court convicted Singh under Section 304 Part II of the Indian Penal Code (IPC) and also invoked Section 30 of the Arms Act.

In addition to the four-year sentence under the IPC, the court has imposed a two-month term under the Arms Act. The ruling includes a directive for Singh to pay Rs 25 lakh in compensation to the family of the deceased. Should he fail to provide this amount, he will face an additional penalty of three months in jail.

Details of the Incident

The case relates to an incident that took place on December 31, 2018, during New Year celebrations at Singh’s farmhouse located in Vasant Kunj, New Delhi. During these celebrations, celebratory gunfire occurred, leading to Dr Archana Gupta sustaining a gunshot wound. Although she was promptly taken to a hospital, she tragically succumbed to her injuries during treatment.

Following the incident, the Delhi Police conducted a thorough investigation, which culminated in a chargesheet being filed against Singh. After the completion of the trial, the court reached a verdict, resulting in the present sentence. Singh’s conviction is now a matter of public record, marking a significant legal outcome in this case.

Singh is currently serving as the MLA for the Sahebganj Assembly constituency, which is situated in Muzaffarpur district of Bihar. He initially entered the state Assembly after winning the 2020 Bihar election under the banner of the Vikassheel Insaan Party (VIP) but later switched allegiance to the BJP.

Impact on Legislative Membership

As Singh has been sentenced to a term exceeding two years, there are serious implications for his membership in the Bihar Legislative Assembly. According to the provisions outlined in the Representation of the People Act of 1951, this conviction could potentially result in his disqualification from the Assembly.
