What are the rules for using green firecrackers in Capital this festival?

On Wednesday, the Supreme Court of India gave its nod to temporary sale and use of green firecrackers in Delhi-NCR, the usage has been allowed from October 18-21. This decision followed many petitions seeking permission to manufacture and sell ‘eco-friendly’ crackers ahead of Diwali.

The bench that gave the decision comprised Chief Justice of India (CJI) BR Gavai and Justice K Vinod Chandran, while giving the orders judges stressed on the balanced approach while celebrating the festival, keeping environment in mind. CJI Gavai said, “We have to take a balanced approach.” He even acknowledged that pollution is a serious issue, but a complete ban will lead to smuggling.

What are the key highlights of the orders?

· NEERI and PESO approved green crackers can only be manufactured and sold.

· Crackers will be distributed to only licensed manufacturers and traders.

· Chemicals like barium, lithium, arsenic, antimony, lead, and mercury usage in manufacturing of crackers is restricted, there will be periodic inspections to monitor compliance.

· Designated areas will have strict cracker bursting time; between 6 pm and 10 pm.

· Online sale of crackers is banned.

· Anyone found not adhering to the order will lead to license suspension and unit seizures.

Besides all the above rules, directions are given to authorities to form patrolling teams across Delhi-NCR for random inspections. In order to address the issue of ‘fake green crackers’, the court has directed to make the verification process stricter and there will be a ‘Green Cess’ to stop polluting crackers. Considering the fact that there was very little effect of complete ban during COVID-19 lockdown, court has resorted to this new approach, which is a combination of environmental responsibility and cultural sensitivity.

Close monitoring of air quality

Directions given to Central Pollution Control Board (CPCB) and state pollution boards to closely monitor the air quality during Diwali and submit reports in advance. This ruling has revisited the Arjun Gopal judgment in 2018, where lesser polluting crackers were given nod. This judgment upholds these principles but with relief to the manufacturers and consumers. Immediately after the orders, Delhi Chief Minister Rekha Gupta shared on X, “We express our gratitude to the Hon’ble Supreme Court for granting permission to use green firecrackers in the capital. This decision respects public sentiments during sacred festivals like Diwali while maintaining a balanced approach towards environmental protection.”
