Vashu Bhagnani Initiates Rs 400 Crore Lawsuit Against David Dhawan

Vashu Bhagnani’s Puja Entertainment has initiated a legal action amounting to Rs 400 crore in the Bombay High Court. This lawsuit targets director David Dhawan, Tips Industries Limited, and producers Ramesh Taurani and Kumar S Taurani. The conflict arises from the purported unauthorized use of songs from the 1999 film Biwi No 1, specifically the recreated tracks “Chunnari Chunnari” and “Ishq Sona Hai,” which have been incorporated into the upcoming film Hai Jawani Toh Ishq Hona Hai.

The suit was lodged through V K Dubey Associates and seeks immediate injunctive relief. Puja Entertainment aims to impede the release, distribution, exhibition, streaming, and any further commercial use of the film, along with all promotional materials associated with the disputed songs. Additionally, the production house has requested the removal of these tracks from the film and a consequent title change to the project.

According to legal representatives for Bhagnani, the claim of Rs 400 crore is directed towards Tips Music Company. The lawyers described the ongoing legal battle as increasingly turbulent, emphasising that the rights of musicians had not been resolved adequately. They detailed the evolving nature of rights agreements in the film industry, noting that music companies typically secure songs from prominent producers or lyricists.

Puja Entertainment has already taken steps to revoke previously granted audio rights, thereby inhibiting Tips Industries from using the contested songs in the forthcoming film. This development follows the assertion that the makers of Hai Jawani Toh Ishq Hona Hai do not possess the necessary permissions to utilise the music tracks from Biwi No 1.

The controversy surrounding this issue has ignited discussions in the industry regarding intellectual property rights, particularly concerning music and its use in cinematic projects. The insistence from Puja Entertainment for a title modification stems from claims that the title Hai Jawani Toh Ishq Hona Hai is derived from the song “Ishq Sona Hai.”

Ramesh Taurani from Tips Industries Limited has publicly stated that the company possesses the legal ownership of the music and audio rights concerning the songs in question. He asserts that the rights have been obtained through appropriate means and that there exists no reason for concern regarding the usage of the songs.

The theatrical release of Hai Jawani Toh Ishq Hona Hai is scheduled for June 5, and the outcome of the lawsuit could significantly impact its distribution.
