Non-Bailable Warrant Issued for Hafiz Saeed in Pahalgam Attack Case

A Jammu court has recently issued a non-bailable warrant against Hafiz Saeed, the leader of the Pakistan-based terrorist organisation Lashkar-e-Taiba (LeT), in connection with the Pahalgam terror attack case of 2025. This significant legal move sets the stage for an impending trial in absentia. The court’s decision follows a supplementary chargesheet filed by the National Investigation Agency (NIA) on July 6, identifying Saeed as an accused and alleging that he masterminded the attack, which occurred on April 22, 2025, resulting in the deaths of 26 individuals, primarily innocent tourists.

The NIA sought the warrant, arguing that Hafiz Saeed is purposely evading arrest. In its application, the agency stated, “(The) Accused is deliberately evading his arrest and NIA prays for issuance of an open dated non-bailable warrant against him to initiate further proceedings in the matter and to take legal action against him at any further investigation.” This plea underscores the NIA’s determination to hold Saeed accountable despite his absence.

Claims of Extraterritorial Conspiracy

The NIA contends that Saeed remains in Pakistan, making it impossible for Indian authorities to secure his presence in court. The agency informed the judiciary that all potential legal means to extradite him have “virtually been exhausted”, prompting a request for the continuation of legal proceedings without his physical presence. According to the NIA, the Pahalgam attack was meticulously planned in Pakistan, with Saeed allegedly playing a pivotal role in the conspiracy.

Additionally, the NIA has indicated a connection between Saeed and several previous attacks against India, emphasising the extent of his involvement in orchestrating terror activities. Under the Bharatiya Nagarik Suraksha Sanhita (BNSS), courts are permitted to conduct trials in absentia in cases where the accused deliberately fails to appear in court while being outside of India and where sufficient evidence exists for prosecution.

Before commencing such a trial, the court is obligated to issue summons and warrants for the accused. In cases where the accused remains absent, they can be declared a proclaimed offender, allowing legal proceedings to advance in their absence.

Ongoing Investigation into Pahalgam Attack

The NIA’s investigation into the Pahalgam attack remains active, as authorities continue to unravel the extensive cross-border conspiracy linked to one of the most devastating terrorist incidents in Jammu and Kashmir in recent history. A prior chargesheet by the NIA named three Pakistani terrorists—Suleman, Jibran, and Hamza Afghani—alongside LeT operative Sajid Saifullah Jatt and Pahalgam locals Bashir Hai Ahmed and Parvez Ahmed as accused in the attack.

The agency is focused on establishing a comprehensive understanding of the framework surrounding the attack and identifying all individuals involved in the intricate plotting. This multi-pronged approach is crucial to ensuring that all responsible parties are brought to justice, reinforcing the commitment to combating terrorism affecting the region.

As the investigation progresses, the NIA will continue to follow legal protocols while remaining vigilant in its pursuit of accountability. The developments surrounding Saeed and the Pahalgam case highlight the broader challenges faced in addressing cross-border terrorism and securing a response that aligns with legal and national security interests.
