The Delhi High Court has denied anticipatory bail to Manoj Kumar Jha, who is accused of impersonating a civil servant to gain access to sensitive government information. This decision was communicated on August 7 during a hearing presided over by Justice Girish Kathpalia. The allegations include attempts to extract confidential details from high-ranking government officials.

Jha is also reportedly accused of impersonating a judge from the Patna High Court. The accusations against him have raised serious legal concerns, leading to his application for anticipatory bail being examined carefully. The case is linked to a First Information Report (FIR) filed at the Parliament Street Police Station under the provisions of the Bharatiya Nyaya Sanhita.

The prosecution outlined that Jha allegedly sought confidential information from various senior government authorities, further complicating his legal standing. The serious nature of these allegations necessitated a thorough investigation and raised questions about his intentions and actions.

Court’s Observations on Police Inaction

The Delhi High Court expressed dissatisfaction with the police’s inaction regarding the apprehension of Jha, despite the repeated denial of his bail applications all the way up to the Supreme Court. Justice Kathpalia remarked that the perceived inaction by law enforcement suggested that the accused might be receiving assistance, raising suspicions about the case’s handling.

In light of these observations, the Court has mandated that a copy of its ruling be forwarded to the relevant Deputy Commissioner of Police for appropriate action. The judiciary’s concern highlights the necessity for law enforcement agencies to act promptly in cases involving serious allegations such as impersonation and fraud.

Furthermore, the Court noted that the lack of arrest could imply an underlying issue that warranted scrutiny from higher authorities. The judge’s comments indicated that judicial oversight was necessary to ensure accountability within the police force regarding their investigative procedures.

Rejection of Anticipatory Bail Plea

The prosecution contended that Jha was involved in multiple criminal cases spanning several states, encompassing charges of impersonation, cheating, and forgery. This comprehensive criminal history weighed heavily on the judgment regarding the bail application, indicating a pattern of unlawful behaviour.

In light of the applicant’s antecedents and the serious nature of the allegations against him, the Court maintained that granting anticipatory bail would not be warranted. Justice Kathpalia’s emphatic rejection underlines the judiciary’s commitment to addressing serious offences with the due diligence they require.
