“Benchmark Verdict”: Maharashtra Deputy CM Eknath Shinde Hails Death Sentence in Nasrapur Child Rape-Murder Case

The CSR Journal Magazine

Maharashtra Deputy Chief Minister Eknath Shinde has expressed his approval of the death penalty issued by a special court in Pune to a 65-year-old man convicted of the horrific rape and murder of a three-year-old girl. The court’s decision has been viewed as a significant legal precedent, with Shinde labelling it a “benchmark verdict.” The case highlights the importance of a timely and effective judicial process in ensuring accountability for severe crimes.

The convict, Bhimrao Kambale, was found guilty of raping and murdering the minor in Nasrapur village on May 1. The judgement was delivered by a fast-track court after a thorough investigation by local law enforcement. Shinde remarked on the diligence of the police in this case, attributing the quick resolution to their efforts and the swift judicial process.

Shinde thanked the court for its decision, recognising the gravity of the crime. He emphasised the collective sentiment surrounding the case, which was that the perpetrator deserved the maximum penalty for his actions. He reiterated the commitment of the Maharashtra government to secure justice for victims and their families.

Involvement of Government Officials

The Deputy Chief Minister noted the active involvement of both himself and Maharashtra’s Chief Minister in monitoring the case closely. He stated, “The Chief Minister himself was taking updates on the case. I worked day and night on this case. I was in touch with the police.” This personal engagement was presented as a crucial element in facilitating the rapid progression of the legal proceedings.

Shinde also highlighted the role of public sentiment in driving the demand for a stringent punishment for the convict. Reports suggest that there was a significant consensus regarding the expectations for a death sentence among the victim’s family and the general public. Throughout the case, the Deputy CM maintained that such sentences are essential to provide justice to the families affected by such grievous crimes.

In his statements, he mentioned having met with the victim’s family and reiterated the necessity of ensuring justice not only for this case but for all others involving crimes against minors. His comments reflect a broader commitment to protect children and uphold their rights.

Legal Proceedings Conclude with Harsh Sentence

The special court in Pune described the crime as “heinous,” reinforcing the necessity of the death penalty given the nature of the offence. The court confirmed on June 25 that the prosecution had successfully established all charges against Kambale beyond a reasonable doubt. Following this guilty verdict, the proceedings quickly moved towards the sentencing phase.

During the hearing, the prosecution, represented by Special Public Prosecutor Advocate Ajay Misar, insisted upon the severity of the crime as a basis for the ultimate punishment. The court agreed, acknowledging the prosecution’s stance by considering references from twelve significant Supreme Court rulings that advocate for capital punishment in cases involving minors.

After reviewing the arguments from both the prosecution and the complainant’s side, the court arrived at its sentencing decision on June 29. The fast-track nature of the trial signifies the growing emphasis on addressing cases of sexual violence against children with urgency and seriousness.
