The Patiala House Court in Delhi has granted 30 days’ interim bail to Sagar Sharma due to the recent passing of his father. Sharma is facing charges related to the Parliament security breach incident that occurred in December 2023. The order was issued by Additional Sessions Judge Amit Bansal on July 17, allowing Sharma to secure bail upon providing a personal bond of Rs.50,000 along with one surety of the same amount.

Circumstances Surrounding the Request

Sagar Sharma’s application for interim bail was prompted by the death of his father, Roshan Lal Sharma, who succumbed to cancer on July 14, 2026. The accused had been in custody since December 14, 2023, and resumed his plea for bail for a period of two months. His counsel, Advocate Somarjuna VM, highlighted the importance of Sharma’s role as the sole breadwinner of his family, which now includes only his mother and sister following this loss.

The advocate emphasised that further rituals, including the Tehravein (13th day) ceremony scheduled for July 22, 2026, necessitate Sharma’s presence. While the cremation had already taken place, the family traditions require him to perform additional rites and support his grieving mother. It was stated that as the only son, Sharma’s involvement is crucial for the emotional and physical well-being of his family during this difficult period.

In response to the application, the Special Public Prosecutor, Akhand Pratap Singh, acknowledged the family’s situation and admitted that the veracity of the father’s death had been verified by the Special Cell of New Delhi. However, he urged the court to impose limited duration and stringent conditions on the interim bail, reflecting the seriousness of the pending charges against Sharma.

Conditions Imposed by the Court

Alongside granting interim bail, the court laid out specific conditions aimed at ensuring compliance and securing the integrity of the ongoing legal proceedings. Sharma is prohibited from making any inducements or threats to witnesses or tampering with evidence related to his case. The court made it explicit that the interim bail cannot be misused, and Sharma must not attempt to flee from justice.

Furthermore, the court mandated that Sharma must seek prior approval from the Trial Court if he intends to leave India during the bail period. As part of the bail terms, he is required to provide his current address and mobile number to both the court and the Investigation Officer within two days of his release from custody.

This ruling highlights the court’s sensitivity towards humanitarian concerns, particularly in light of a family tragedy, while balancing the need for adhering to judicial protocols and safeguarding the proceedings of the case against Sharma.
