Delhi High Court Issues Notice to Kala Hiran Makers After Salman Khan Alleges Personality Rights Violation

The CSR Journal Magazine

The Delhi High Court issued notices to the producers of the film ‘Kala Hiran: The Battle for Legacy’ following a petition by prominent actor Salman Khan. On June 16, the court, presided over by Justice Neena Bansal Krishna, ordered that notices be served to those involved with the film, including producer Amit Jani of Jani FireFox Films, director Bharat Shrinate, and casting director Akshay Pandey. The next court appearance in this matter is scheduled for June 19.

Claims of Personality Rights Breach

Khan’s legal representative, advocate Nizam Pasha, informed the court that a promotional poster released on May 29 featured a character that closely resembled the actor. Pasha pointed out that the character was depicted wearing a bracelet similar to one that is often associated with Khan. Allegedly, this film violates a court ruling from December 11, 2025, which was enacted to protect Khan’s personality rights.

During the hearing, Pasha emphasized that the film infringes upon the previous court order that safeguards Khan’s identity and recognisable traits. He highlighted that, despite no official release date being confirmed by the filmmakers, the trailer for the movie was released on June 16, contradicting previous announcements indicating a trailer launch on June 20.

In light of the ongoing blackbuck poaching case involving Khan, Pasha noted that there are still outstanding legal matters pertaining to this issue. He mentioned that four FIRs have been filed concerning the case, with Khan acquitted in three instances. A Special Leave Petition (SLP) remains active in relation to the remaining FIR, but without any definitive order. Pasha argued that the filmmakers are attempting to exploit Khan’s identity for commercial gain and requested an injunction to prevent the film’s release.

Concerns Regarding Promotional Material

As the court inquired about the film’s release schedule, Khan’s legal team clarified that no official release date had yet been declared by the producers. The actor’s plea states that promotional materials for the film contain explicit references to his likeness, leading to concerns about the infringement of his rights.

The legal application put forth by Khan asserts that the portrayal of a character in promotional content resembles him closely, including the recognisable bracelet that serves as a notable personal trademark. Khan contends that the unapproved use of his image, likeness, and personal attributes constitutes a violation of established legal protections and personality rights.

In summary, Salman Khan’s legal actions against the ‘Kala Hiran’ makers highlight significant concerns surrounding intellectual property and personality rights in the Indian film industry. With the case pending further court hearings, the implications of this dispute could set precedents for how similar cases are addressed in the future.
