Court to Deliver Decision on Anticipatory Bail Applications Linked to Nithin Raj’s Death

The Additional District Court-IV in Thalassery is scheduled to announce its decision regarding anticipatory bail applications on April 25. These applications were submitted by two doctors implicated in the case involving the death of Nithin Raj, a first-year Bachelor of Dental Surgery (BDS) student. The individuals seeking bail are MK Ram, the primary accused, and KT Sangeeta Nambiar, the second accused. Both have been charged under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, which is designed to protect members of these communities from discrimination and violence.

Prosecution’s Arguments Against Bail

The prosecution, represented by Public Prosecutor K Ajith Kumar, contended that the accused should not be granted anticipatory bail in relation to a case filed under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. The prosecutor challenged the claim made by Dr Ram, who asserted that he belongs to the Bajendri community of Karnataka, thus exempting him from allegations of caste-based abuse against Nithin Raj. In support of their argument, the prosecution presented certificates demonstrating that the Bajendri community is classified as Other Backward Classes (OBC) and not as part of the Scheduled Castes.

During the hearing, the prosecution outlined a series of events that reportedly occurred in the staff room and the principal’s chamber on the day of the incident. They referred to CCTV footage that had been collected by police and submitted to the court. This footage was claimed to contradict Dr Ram’s assertion that he was not present on campus that day. The prosecution argued that the evidence suggests otherwise.

Another key element presented by the prosecution was the allegation involving Dr Ram’s comments when Nithin Raj was brought to the casualty department after being found in distress on April 10. Witnesses claimed that Dr Ram remarked the incident occurred “to gain sympathy,” highlighting a perceived lack of empathy towards the student, as supported by multiple witness accounts.

Furthermore, the prosecution indicated that the CCTV footage revealed Dr Ram’s presence in the staff room while Nithin Raj was being interrogated in the principal’s office concerning issues related to a loan app controversy. It was noted that Dr Ram was seen stepping out frequently to monitor the circumstances surrounding the inquiry. Additionally, visuals reportedly showed him congratulating a teacher involved with the loan app situation, raising questions about his involvement.

Student testimonials presented by the prosecution detailed allegations that Dr Ram referred to Nithin Raj as a “dog,” a term that many consider derogatory. This conduct, coupled with accusations of humiliation and harassment, was argued as a contributing factor that led the student to take his own life. In attendance at the court proceedings were Nithin Raj’s father, LY Raj, and his brother-in-law, MS Ashok, who are advocating for justice on behalf of the family.

The family has expressed their belief that Nithin Raj’s death may have been a planned act of murder, holding the college authorities partly responsible for the circumstances. Legal representatives for both the family and the accused presented their arguments during this critical phase of the case. The court is expected to resolve the bail plea on Friday, adding further developments to an already high-profile case.
