Uttar Pradesh Woman Alleges Rape By Brother-In-Law After Triple Talaq

The CSR Journal Magazine

A woman in Bijnor district, Uttar Pradesh, has made serious allegations against her husband and brother-in-law, claiming that after being subjected to triple talaq, she was forced into a temporary marriage (nikah halala), during which she was allegedly raped. The woman reported that she married Nadeem approximately one year ago and faced ongoing hardship due to dissatisfaction from her in-laws despite providing a substantial dowry package, including household items, a motorcycle, jewellery, and Rs 2 lakh in cash.

The victim asserted that on the night of May 19, her husband physically assaulted her, causing significant pain related to a past surgical procedure. During the attack, Nadeem reportedly pronounced ‘talaq’ three times, demanding that she leave their home. After this incident, she sought police assistance but was persuaded by her husband’s family to return with the promise that he would take her back.

According to her complaint, prior to a planned remarriage on May 30, Nadeem reportedly instructed her that she must first undergo halala with his elder brother, Waseem. Despite her objections, she alleged that Waseem subsequently raped her in what was purported to be part of the halala procedure, which he insisted she must comply with.

Confinement and Further Allegations

The woman claimed that after the alleged assault, she was confined to the house and faced violence whenever she tried to leave. Despite her restrictions, she managed to reach out to her relatives. Following this, her sister-in-law arrived and assisted her in leaving the situation. She felt compelled to contact the police once again regarding her ordeal.

In her second attempt to secure legal assistance, she reported that no case was registered initially, which led her to approach the Superintendent of Police (SP) in Bijnor before the formal registration of the First Information Report (FIR) occurred. This delay added to her distress and frustration. Following her persistent efforts, the police registered a case against her husband, Nadeem, and a separate case for rape against Waseem.

Additionally, Waseem’s wife, Nagma, has been implicated in the FIR for allegedly aiding the accused in these actions. The case is reportedly under investigation, and the police are taking her complaints seriously as they collect further evidence. The woman continues to seek justice and support from law enforcement regarding the incidents she has endured.

Ongoing Investigation and Community Response

The investigation into this case has garnered attention within the local community, highlighting issues related to women’s rights and protection against domestic violence. Authorities are reportedly taking measures to ensure the woman’s safety as they delve into the allegations made against both Nadeem and Waseem.

As the legal proceedings unfold, there is an increased focus on the treatment of women within marriages, particularly concerning practices like triple talaq and nikah halala, which have been subjects of public debate in India. Community leaders and activists are calling for more stringent measures to prevent such incidents and ensure the protection of women’s rights in such circumstances.

This case has sparked conversations about the need for reform and greater awareness regarding women’s issues in the region. The victim’s plight is being closely monitored as she seeks recourse through the justice system, emphasising the importance of not only addressing the specific allegations but also providing broader support for women’s rights and services tailored to victims of domestic abuse and sexual violence.
