RG Kar case reassigned to new Calcutta HC division bench after judicial recusal

The CSR Journal Magazine

A significant development has taken place in the ongoing legal proceedings related to the rape and murder of a junior doctor at R.G. Kar Medical College and Hospital, with the matter being reassigned to a newly constituted Division Bench of the Calcutta High Court after the recusal of Justice Rajasekhar Mantha.

Following the recusal on personal grounds, Chief Justice Sujoy Paul directed that the case will now be heard by a bench comprising Justice Shampa Sarkar and Justice Tirthankar Ghosh.

The first hearing before the new bench is expected to take place as early as next Monday, according to legal sources.

Previous bench highlighted complexity and public importance

During earlier proceedings, Justice Rajasekhar Mantha had reportedly observed that the case had grown increasingly complex, with a mounting number of petitions and heightened public attention across West Bengal.

The court had noted that the matter required sustained judicial attention due to its sensitivity and wide-ranging implications. It was also observed that petitions filed by multiple parties — including the victim’s family, accused individuals, and the Central Bureau of Investigation (CBI) — required detailed examination.

Justice Mantha had further indicated that transferring the matter to another bench was a procedural step intended to ensure a more comprehensive and uninterrupted hearing process.

Proposal for judicial commission under consideration

Meanwhile, sources within administrative circles suggest that the state government is exploring the possibility of constituting a high-level Judicial Commission to examine broader aspects of the incident and related developments.

Political observers view the proposal as part of a wider effort to revisit several high-profile controversies in the state, including incidents such as Sandeshkhali, alongside the RG Kar case.

If implemented, the commission could function alongside the ongoing investigation being conducted by the Central Bureau of Investigation (CBI) under judicial supervision.

Potential for parallel investigations

The case is currently under investigation by the CBI with oversight from the judiciary. Experts caution that the formation of a separate Judicial Commission could introduce a parallel fact-finding process alongside the criminal probe.

Legal analysts note that such a scenario may add layers of complexity to an already closely watched case, potentially influencing both judicial proceedings and administrative scrutiny.

Political and legal implications

Observers believe that any move to establish a Judicial Commission could carry significant political and legal implications, particularly given the high-profile nature of the case and its continued public sensitivity.

The RG Kar incident remains one of the most closely followed criminal cases in West Bengal in recent years, with ongoing proceedings expected to shape its legal trajectory in the months ahead.
