RERA Project Deadlines Extended by Four Months Affecting Home Possession

The recent decision to extend completion deadlines for housing projects has been largely influenced by ongoing geopolitical tensions in West Asia. These tensions have disrupted global supply chains, posing challenges for construction activities in India. The Ministry of Housing and Urban Affairs (MoHUA) confirmed that this measure aims to assist developers who are struggling to source essential materials and equipment, which further complicates project timelines.

The Department of Expenditure, under the Ministry of Finance, has declared the situation in West Asia as a “Force Majeure” under Section 6 of the Real Estate (Regulation and Development) Act, 2016. This classification allows for project timelines to be extended due to exceptional circumstances such as war or natural disasters, thereby providing a legal framework for the recently announced extensions.

Among the key materials affected are cement, steel, aluminium, and copper, which are vital to the construction process. Increased logistics and shipping costs have compounded these issues, making it difficult for developers to adhere to their original schedules.

Eligible Projects for the Extension

The extension applies to registered housing projects with original completion dates of on or after February 28, 2026. This also encompasses projects that have had their completion dates revised or previously extended, as long as these extensions fall on or after the stipulated date. Developers may receive a one-time extension of four months to finalise their projects.

Importantly, developers will not be required to submit separate applications for this deadline extension. The Centre has urged State RERA authorities to implement a common order that will automatically apply to eligible projects. This streamlined approach is intended to minimise administrative delays that could further hinder project completions.

This could ease some of the pressures developers face and allow them to focus on completing their projects with less bureaucratic red tape involved in obtaining extensions.

Implications for Homebuyers

The government’s rationale for this extension is that it will ultimately benefit developers by allowing projects to be completed rather than left unfinished. While this may ease the burden on the real estate sector, homebuyers must brace themselves for the possibility of delays.

As a result, it is advisable for buyers to stay in communication with their builders and consult the relevant RERA authorities regarding updated completion schedules. Continuous updates will provide clarity on when possession may be expected and help in managing personal arrangements.

Market analysts are monitoring the potential broader impacts on the housing sector. Property consultancy firm Anarock has indicated that disruptions could affect the delivery of approximately 54 lakh homes across the country. Rising construction costs may further complicate timelines and availability of materials if geopolitical issues persist.
