Pawan Khera Approaches Supreme Court Over Gauhati High Court Bail Rejection

The CSR Journal Magazine

Congress leader Pawan Khera has filed a petition with the Supreme Court, challenging an order from the Gauhati High Court that denied his anticipatory bail request. This development follows a ruling dated April 24, which concerns a defamation and forgery case initiated against Khera by the Assam Police.

The legal troubles began when Riniki Bhuyan Sarma, the spouse of Assam’s Chief Minister Himanta Kumar Sarma, lodged a First Information Report (FIR) against Khera. The FIR was based on allegations that Khera made during a press conference, where he claimed that Riniki Bhuyan Sarma possesses multiple foreign passports and undisclosed assets situated abroad.

Despite earlier legal manoeuvres, Khera’s attempts to secure bail have faced significant challenges. His initial plea for transit anticipatory bail was granted by the Telangana High Court, allowing him to approach any jurisdictional court in Assam. However, this relief was later contested by the Assam Police in the Supreme Court.

Supreme Court Developments

On the request of the Assam Police, the Supreme Court intervened and put a stay on the transit anticipatory bail granted by the Telangana High Court. The apex court expressed concerns over Khera’s intent when seeking relief, describing his approach to the Telangana High Court as “forum shopping.” This term suggests that Khera may have attempted to exploit legal loopholes to evade arrest.

During the hearing, the Supreme Court noted that Khera allegedly presented a forged identity document to gain favour from the High Court. These allegations prompted the apex court to scrutinise Khera’s actions further, ultimately responding to the Assam Police’s challenge.

However, the Supreme Court has also clarified that Khera retains the right to approach any appropriate jurisdictional court in Assam. The court reassured him that previous orders from both the Supreme Court and the Telangana High Court would not impede the decision-making process of the jurisdictional court regarding Khera’s case.

Implications and Future Steps

Khera’s move to the Supreme Court signifies his continued attempts to navigate the legal landscape related to the FIR filed against him. The situation reflects the complexities involved in cases where political figures are accused of criminal activities, as well as the judicial system’s role in addressing such allegations.

The outcome of this petition may set a precedent regarding the handling of anticipatory bail applications in politically sensitive cases. Legal experts suggest that the Supreme Court’s observations may influence how similar cases are treated in the future, particularly in terms of allegations surrounding document authenticity.

As the case progresses, the focus will remain on how the jurisdictional courts in Assam interpret the Supreme Court’s directives and whether Khera will find relief from arrest. The legal developments following this Supreme Court petition will be closely monitored by both the political and legal communities in India.
