NIA Special Court Sentences Four Bangladeshi Nationals in Transnational Human Trafficking Case

The CSR Journal Magazine

A special court under the National Investigation Agency (NIA) has convicted and sentenced four Bangladeshi nationals for their involvement in a transnational human trafficking case. The court, situated in Bengaluru, Karnataka, imposed a rigorous imprisonment term of three years on the accused individuals: Zakir Khan, Badal Houladar, Kabir Talukdar, and Mohammed Bachchu Gharami. In addition to the prison sentence, each accused has been fined Rs 20,000.

As a condition of the sentence, the individuals will face an additional month in incarceration if they fail to pay the imposed fines. The court’s decision falls under relevant sections of the Foreigners Act and the Passports (Entry into India) Act, reflecting the seriousness of the offence they committed.

Details of the Charges

The individuals had previously admitted to unlawfully entering India from Bangladesh through routes like Benapole, Jashore, and Akhaura. They reportedly acquired Indian identity documents through fraudulent means and were active in the waste segregation business in Bengaluru’s suburban areas. Investigations by the NIA revealed that the accused also employed other Bangladeshi nationals who had been trafficked into India.

Furthermore, it emerged that the accused leased land in Bengaluru to construct facilities specifically used for housing trafficked individuals of Bangladeshi origin. Such activities highlighted the organised nature of their illegal operations and the challenges surrounding cross-border human trafficking.

The NIA initiated the case in November 2023, acting on its own accord after uncovering a comprehensive cross-border human trafficking racket. This crackdown was based on intelligence gathered and careful tracking of the activities of these individuals.

Ongoing Investigations and Arrests

Following the initial investigations, the NIA carried out an extensive search across the country, which led to the apprehension of twelve other individuals allegedly connected to the trafficking network. During these operations, the NIA seized Bangladeshi identity documents, digital devices, and fraudulently obtained Indian identity papers, along with a significant amount of Indian currency.

The NIA filed a chargesheet against the convicted individuals in February 2024. Subsequently, in May 2024, two additional suspects were taken into custody in connection with the same case. This reflects the agency’s ongoing efforts to dismantle the entire trafficking operation effectively.

The NIA has confirmed that its investigations are still ongoing, targeting the broader cross-border trafficking network to ensure that all individuals involved are comprehensively dealt with under the law. The agency’s commitment to tackling human trafficking and related crimes remains a priority as it seeks to bring all perpetrators to justice.
