In a recent session of the Rajya Sabha, Mallikarjun Kharge, Leader of the Opposition, spotlighted the government’s failures regarding examination management. He vocally condemned the recurring problem of examination paper leaks and demanded the implementation of a National Youth Employment Strategy, along with a fixed annual examination calendar. Within his discourse on the Public Examinations (Prevention of Unfair Means) Amendment Bill, 2026, Kharge articulated that the frequent postponements and leaks of examination papers were adversely affecting young candidates, with many being unable to apply due to age limits being reached while awaiting recruitment results.

Kharge elaborated on the need for reform, stating that uncertainties around examination schedules had significant implications for students. He argued that a systematic approach is essential to ensure that the government is held accountable for handling these critical issues. He emphasised that the establishment of an annual examination calendar is crucial to mitigate the anxiety faced by students in the current unpredictable landscape.

Furthermore, he called for a comprehensive employment strategy, asserting that investments should yield substantial quality employment opportunities for the youth. He posited that a well-articulated National Youth Employment Strategy should be presented in Parliament, outlining how to cultivate a conducive business environment and attract investment in India.

Concerns Over Recruitment Processes and Police Action

Kharge pressed the Centre to expedite the recruitment process, particularly filling vacancies in public sector positions reserved for Scheduled Castes and Other Backward Classes. He expressed concerns about police actions against protesters, calling for an investigation supervised by the High Court. He stated that clear demands needed to be met, including establishing a fixed examination calendar, a transparent probe into recent incidents, and comprehensive recruitment to fill public sector vacancies.

During the session, the discussion turned contentious when Kharge referred to the caste system and quoted the ‘Manusmriti’, which drew objections from members of the ruling party, questioning the validity of his statements. Despite the backlash, Kharge remained steadfast, reiterating the necessity for accountability and thorough investigations into the systematic issues plaguing the examination framework.

Kharge’s address also highlighted the apparent lack of accountability related to past paper leak incidents, noting no convictions had been made in such cases. He argued that simply introducing stringent penalties would not address underlying issues, as past instances have illustrated a failure to deliver justice.

Legislative Framework and Government Responses

In light of ongoing examination-related controversies, Union Minister Jitendra Singh introduced the Public Examinations (Prevention of Unfair Means) Amendment Bill, 2026, to the Rajya Sabha. Having been previously passed in the Lok Sabha, Singh noted that the bill aims to refine the previous legislation and is motivated by a commitment to uphold the future of students.

The amendments in the bill include increased penalties for unfair practices, with proposed prison terms raised from three years to a minimum of five years, extendable to ten. This also applies to organised examination crimes, where the penalty could now extend to seven years, with a fine increase from Rs 1 crore to Rs 10 crore for serious offences.

Additionally, the bill would empower the Centre to form a Special Task Force and set up Special Fast Track Courts to handle crimes connected to examinations. Singh made a fervent appeal for bipartisan support from other leaders to ensure the swift passage of the legislation, framing it as part of the government’s long-standing commitment to rectify past oversights in handling examination integrity.
