The CSR Journal Magazine

The Gujarat Anti-Terrorist Squad (ATS) has detained eight individuals who are allegedly affiliated with the proscribed terrorist group Jaish-e-Mohammed (JeM). These individuals purportedly aimed to establish a functional terror network within the state of Gujarat to promote activities of the organisation. The arrests occurred just prior to the group’s intended execution of a significant terror plan.

According to reports from the Gujarat ATS, the individuals had been actively involved in efforts on behalf of the Pakistan-based organisation for a duration of approximately six months. Officials stated that the arrests were strategic, targeting the group before they could execute any major actions.

Seven individuals were apprehended across various districts of Gujarat, while one was arrested in the neighbouring state of Madhya Pradesh. The specifics of the operations include the arrest of three individuals from Banaskantha, three from Patan, one from Navsari, and one from Dewas in Madhya Pradesh.

Identification of the Accused

The individuals taken into custody have been identified as follows: Ahmed Abdullah Gajiwala, also known as Abu Ubaida (19), Ibrahim Mohammad Husen Ghagha, alias Abu Hamza (30), and Mudassir Abdullah Ghaziwala, known as Abu Aya (22), all residents of Bhagal in Palanpur, Banaskantha.

Others apprehended include Zakariya Durani Mohammad Ammar Ghagha, also referred to as Ibn Ammar or Zakariya Palanpuri (21), from the Jamia Abul Hasan Madrasa in Khadiyasana, Siddhpur, Patan. Additionally, Mufti Faujan Ismail Dauwa, known as Mufti Sahab (40), and Mohammad Amin Shera, alias Amin Palanpuri (21), are associated with the same madrasa. Another individual, Mohammad Abdul Rahman Savdi, also known as Mohammad Palanpuri or Abu Unisa (22), is linked to Jamia Rahmaniya Khambhiya in Ambheta, Chikhli, Navsari.

The last individual is Bilal Durani Mohammad Ammar Ghagha, known by multiple aliases, including Abu Dujana (18), who is a resident of Warsi Nagar, Dewas, Madhya Pradesh.

Legal Action and Ongoing Investigations

The ATS has initiated legal action against all eight suspects at the ATS Police Station. The case has been registered under several sections of the Unlawful Activities (Prevention) Act, 1967, including Sections 13 (punishment for unlawful activities), 17 (punishment for raising funds for terrorist acts), 18 (punishment for conspiracy), 38 (offence relating to membership of a terrorist organisation), and 39 (offence relating to support provided to a terrorist organisation).

Moreover, Sections 148 and 61 of the Bharatiya Nyaya Sanhita (BNS), 2023, have also been invoked in this proceeding. Section 148 addresses conspiracies to commit offences punishable under Section 145 of the BNS, while Section 61 pertains to criminal conspiracies. Additionally, Section 147 of the BNS relates to actions pertaining to waging war or attempts to engage in war against the Government of India.

The Gujarat ATS has expressed that the accused aimed to expand the reach of Jaish-e-Mohammed by establishing an active network in Gujarat, contributing to the larger objectives of the banned organisation. The investigation into the matter is ongoing as authorities gather further evidence.
