Delhi High Court Orders Restoration of Cockroach Janta Party’s X Account

The Delhi High Court has issued an order for the reinstatement of the Cockroach Janta Party’s X account, previously known as Twitter. This decision was made on July 7 during a hearing that centred on the rationale behind the Union Government’s decision to block the account. The court established that the primary concern, which had justified the blocking, was no longer valid as the National Eligibility cum Entrance Test (NEET) had concluded.

Justice Swarana Kanta Sharma presided over the case and allowed the petition filed by Abhijeet Dipke, challenging the suspension of the party’s account. The court emphasised the relevance of the earlier concerns expressed by the Centre, directly linking them to the NEET examination which had now been completed, rendering the concerns obsolete.

In her ruling, Justice Sharma directed that the account be unblocked, noting that without the ongoing NEET examination, the justification for blocking the account was weakened. The decision reflects the court’s position on the matter and underscores its commitment to uphold rights concerning online platforms.

Arguments Presented During the Hearing

The case saw representations from both sides, with Senior Advocate Akhil Sibal advocating for Abhijeet Dipke. Sibal contended that while specific posts may be deemed objectionable, the overall account should not remain suspended. He argued that there are precedents where courts had permitted the accounts in question to be reinstated even while maintaining limitations on individual postings.

During earlier proceedings, Justice Purushaindra Kumar Kaurav had considered the petition but opted not to grant any interim relief at that time. The case was referred to the statutory Review Committee in accordance with the Information Technology (Procedure and Safeguards for Blocking for Access of Information by Public) Rules, 2009, for further examination of the complaints raised by Dipke. This review process was intended to ensure a thorough assessment of the basis for the account’s suspension.

The Union Government had raised reservations about the potential implications of unblocking the account, citing concerns over activity associated with the account that warranted its initial suspension. However, with the NEET examination now completed, the court found these objections to lack sufficient weight to justify a continued ban.
