The Delhi High Court has dismissed the bail application of Naresh Balyan, a former Member of the Legislative Assembly (MLA) for the Aam Aadmi Party (AAP), on August 3. This ruling was made in connection with a case filed under the Maharashtra Control of Organised Crime Act (MCOCA). Balyan has been accused of having ties to an organised crime syndicate reportedly led by the fugitive gangster Kapil Sangwan, also known as Nandu.

Details of the Case Against Balyan

Balyan was apprehended by the Delhi Police Crime Branch on December 4, 2024. The prosecution claims that he was involved with an organised crime syndicate purportedly operated by Sangwan. Key evidence cited includes an audio recording allegedly featuring a mobile phone conversation between Balyan and the gangster.

During the court proceedings, Senior Advocate Rebecca M John, representing Balyan, argued that the allegations against her client were unfounded. She referenced a recent ruling by a Delhi trial court that had dismissed an extortion case connected to the same audio clip.

On July 31, the Rouse Avenue Court ruled to close the extortion investigation initiated by the Delhi Police against Balyan. In that ruling, Additional Chief Judicial Magistrate Paras Dalal remarked that the prosecution had failed to provide “even an iota of evidence” to substantiate Balyan’s involvement in any alleged criminal activity.

Seniors advocates Rebecca M John and her team, which included Jatan Singh, Vivek Jain, Rohit Kumar, Sadiq Noor, and Pravir Singh, represented Balyan during the hearing. The State’s case was supported by Special Counsel Amit Prasad and Special Public Prosecutor Akhand Pratap Singh, along with advocates Hritwirk Maurya, Ayodhya Prasad, and Utkarsh Singh.

Naresh Balyan previously served as an MLA for the Uttam Nagar Assembly constituency in the Delhi Legislative Assembly. He was an active member of AAP prior to his arrest in connection with the ongoing MCOCA case. The legal proceedings surrounding his case continue to attract public attention, especially due to the allegations involving high-profile criminal elements.

The dismissal of Balyan’s bail request indicates a significant development in the ongoing legal matter, reinforcing the seriousness with which the High Court views cases under the MCOCA.
