19 Dissident TMC MPs Move to Join Nationalist Citizens Party of India

The recent discord within the Trinamool Congress (TMC) has escalated as nineteen rebel Members of Parliament (MPs) have purportedly pursued a merger with an obscure political group, the Nationalist Citizens Party of India (NCPI). This development occurred on Sunday when the MPs formally approached the Lok Sabha Speaker, advocating for their unification under the NCPI banner. They submitted a letter indicating twenty endorsements, although one MP could not attend the meeting due to commitments abroad.

In addition to their request for a merger, these lawmakers have demanded distinct seating arrangements within the Lok Sabha, distancing themselves from the opposition coalition known as INDIA. They simultaneously expressed their allegiance to the ruling National Democratic Alliance (NDA), suggesting that they might later assert their status as the “real Trinamool Congress.”

Senior TMC leader Sudip Bandyopadhyay asserted that their faction commands a two-thirds majority within the parliamentary party, claiming support from twenty MPs. While the group has not yet sought to claim the party name fully, Bandyopadhyay mentioned potential legal action during the Monsoon Session to support their assertion of being the authentic representation of TMC.

Political Strategies and Legislative Dynamics at Play

This unfolding situation appears to be orchestrated by a calculated political strategy aimed at achieving specific legislative goals. The central government plans to introduce crucial Constitutional Amendment Bills during the forthcoming Monsoon Session, which necessitate a two-thirds majority for passage. Observers speculate that the push to integrate the TMC MPs into NDA frameworks was carefully choreographed to align with this legislative imperative.

Speculation also surrounds the involvement of the Bharatiya Janata Party (BJP) in these developments. Rebel MPs have been reportedly meeting frequently at the residence of Union Minister Bhupender Yadav, where BJP MPs Nishikant Dubey and CM Ramesh were present. Additionally, rebel leaders have engaged with Home Minister Amit Shah, reinforcing the belief that the BJP is influential in the ongoing situation.

However, this approach is not without challenges. Some leaders in the West Bengal BJP are apprehensive about the implications of aligning closely with former adversaries, fearing it could negatively affect their grassroots support. Conversely, the rebel MPs remain wary of the repercussions should their legal justifications falter, risking their positions in the Lok Sabha.

TMC Leadership Takes Legal Measures Against the Rebel Faction

In response to the dissent, TMC leadership has proactively initiated legal measures. General Secretary Abhishek Banerjee has communicated with the Speaker, referencing a significant Supreme Court ruling in the Subhash Desai vs. Governor of Maharashtra case. In this letter, the TMC asserts that the original political party retains supremacy over its legislative members, arguing that a legitimate merger requires the parent party to agree to such an action. The party contends that a breakaway faction of MPs does not possess the authority to validate a merger on its own.

Legal experts have also scrutinised the actions of the rebel MPs. Senior advocate Kapil Sibal has raised concerns regarding the legality of these lawmakers joining another political party without endorsement from the TMC. He highlighted that such a move provides a solid basis for possible disqualification under existing regulations.

As the situation develops, the focus now shifts to Lok Sabha Speaker Om Birla, who faces the critical task of evaluating the claims from both factions. His decision regarding the recognition of the merger with the NCPI and the request for separate seating arrangements is expected to have significant legal ramifications that could result in prolonged court disputes.
