Trump Calls Birthright Citizenship Ruling ‘Miscarriage Of Justice’, Seeks Rehearing

US President Donald Trump on Wednesday said he would immediately seek a rehearing before the US Supreme Court after the court upheld the principle of birthright citizenship, calling the decision a “miscarriage of justice” that could have serious consequences for the country.

Trump alleged that birthright citizenship was being promoted along the US southern border and in Mexico as a way for foreign nationals to secure American citizenship for their children by paying to give birth in the United States. The ruling marked a setback for the president, who has made restricting birthright citizenship and tightening immigration policies key priorities.

Trump Alleges Birthright Citizenship Being Advertised

In a post on Truth Social, Trump claimed that signs and billboards advertising birthright citizenship had appeared along the southern US border and in Mexico.

“Signs and Billboards are being put up all over our Southern Border, and Mexico, advertising BIRTHRIGHT CITIZENSHIP, with ‘Deliveries starting at $4000,’” Trump wrote.

The US president alleged that the practice would allow foreign nationals to obtain citizenship for their children by paying to give birth in the country, potentially allowing other family members to follow.

“Billions of Dollars will be illegally made by this SCAM, with Citizenship going to anyone willing to pay. It will be, by far, the number one way of becoming a citizen, and then the entire family will be allowed to follow. Not sustainable,” Trump said.

Declaring that “AMERICAN CITIZENSHIP IS NOT FOR SALE!”, Trump said he would immediately seek another hearing before the country’s highest court.

“The Supreme Court’s ruling is wrong. I will be asking for a Rehearing by the United States Supreme Court, IMMEDIATELY,” Trump wrote.

“This miscarriage of justice will destroy America if they don’t change their absolutely insane decision,” he added.

Trump Says Citizenship Provision Was Meant For Children Of Slaves

Trump had earlier renewed his criticism of the Supreme Court’s position on birthright citizenship while speaking at the opening of the Theodore Roosevelt Presidential Library.

The president praised other recent Supreme Court decisions that he said had restored presidential authority but maintained that the justices had reached the wrong conclusion on birthright citizenship.

“We’ll take care of the birthright citizenship because that was not meant for rich people from other countries. It was meant for the babies of slaves,” Trump said.

“I believe, no, I know they got it wrong, but that’s okay,” he added.

Supreme Court Upholds Birthright Citizenship In 6-3 Ruling

Trump’s remarks came after the US Supreme Court upheld the principle of birthright citizenship in a 6-3 decision, affirming that children born in the United States to parents who are unlawfully or temporarily present in the country are entitled to automatic US citizenship under the Citizenship Clause of the Fourteenth Amendment.

According to CNN, the Supreme Court reaffirmed its earlier precedent in United States v. Wong Kim Ark, which established that children born on US soil to foreign parents are entitled to birthright citizenship.

One of the key arguments advanced by the Trump administration was that the Fourteenth Amendment required parents to be domiciled in the United States before their children could claim birthright citizenship.

Writing for the majority, Chief Justice John Roberts said, “Citizenship, then and now, was the right to have rights — to freely participate in our political community.”

“The Framers of the Fourteenth Amendment extended that promise to ‘every free-born person in this land.’ We keep that promise today,” Roberts wrote, according to CNN.

The ruling dealt a setback to Trump, who had made ending “birth tourism” and imposing stricter immigration policies key issues during his second presidential campaign.
