Rajpal Yadav Settles Rs 2.5 Crore of Rs 11 Crore Outstanding: Lawyer in Cheque-Bounce Case

The CSR Journal Magazine

The Delhi High Court has postponed the hearing concerning actor Rajpal Yadav’s bail application to February 16 in an ongoing cheque-bounce case. During the proceedings, Yadav’s legal representative informed the court that the actor has already remitted Rs 2.5 crore towards the disputed amount and is willing to make further payments. Following the hearing, Yadav’s lawyer, Bhaskar Upadhyay, provided details to the media regarding the case.

Actor’s Partial Debt Repayment Highlighted

Upadhyay disclosed that Yadav has repaid part of a Rs 5 crore loan taken for the film “Ata Pata Lapataa.” He articulated that imprisonment should not be considered in financial disputes based solely on an undertaking. The lawyer stated, “No one should be imprisoned solely on the basis of an undertaking. We mentioned to the court that if this is purely a financial matter, we would consult him in jail for instructions. Attempts to meet him today were unsuccessful; however, we plan to connect in person to clarify the court’s stance on the earlier undertaking.” He reiterated that a prompt payment would allow the matter to be treated as settled rather than argued on its merits.

Consent Decree and Its Implications

Upadhyay explained that there had been a consent decree of Rs 5 crore, which was subsequently executed. He noted that the opposing party declined to accept payment at one stage, as documented in the order sheet. Amidst ongoing disputes, they sought Yadav’s imprisonment. To enforce the decree, the court had imposed a three-month prison sentence. This legal process traces back to earlier proceedings initiated in 2012.

Current Financial Standing and Court Proceedings

The lawyer further elaborated that the initial Rs 5 crore has now escalated to Rs 11 crore. To date, a total of Rs 2.5 crore has been paid, with approximately Rs 1 crore previously deposited with the court registry. A cheque amounting to Rs 25 lakh was also brought to court recently. According to Upadhyay, all necessary assistance is being coordinated to facilitate the payment. He stated, “There is no significant issue regarding the payment front. The only remaining query is the court’s decision scheduled for Monday.”

Notice Issued to Murli Projects Company

On February 12, the court directed Murli Projects Company, which had granted Yadav the initial Rs 5 crore loan in 2010 for his first directorial project, to respond to the bail application. The ongoing matter pertains to nearly Rs 9 crore that Yadav is alleged to have failed to repay. During the hearings, Yadav’s legal team requested additional time from the court to obtain further instructions regarding the payment plan.

Support from Bollywood and Political Circles

In light of the case gaining public attention, several individuals within the Bollywood industry and political sphere have reportedly pledged financial aid to assist Yadav in raising the required funds for payment. The developments in this legal matter continue to unfold as the next court appearance approaches.
