The Delhi High Court has issued a warning regarding the potential suspension of vote counting for the Delhi University Students’ Union (DUSU) elections, should authorities fail to address reported acts of violence and misconduct during the electoral process. The bench, comprising Chief Justice D K Upadhyaya and Justice Tejas Karia, articulated that “democracy cannot be converted into a criminal society” while deliberating on a petition about the elections.

Concerns Over Electoral Conduct Raised

The court has directed Delhi University, the Delhi Police, and the Delhi government to provide comprehensive reports by the following day, detailing measures taken to address the incidents raised in the petition. Furthermore, the court ordered that copies of its directive be sent to high-ranking officials, including the Delhi Police Commissioner, the Delhi Chief Secretary, and the Lieutenant Governor.

During the hearing, the bench expressed significant concern regarding alleged acts of violence and the participation of unruly individuals during the campaigning phase at North Campus. Notably, the court highlighted that past DUSU elections had seen similar issues, leading to previous injunctions aimed at securing a peaceful voting atmosphere.

Despite previous affirmations from Delhi University and police that proactive steps would be implemented, the court indicated that evidence presented portrayed an “almost complete failure” to uphold the electoral integrity. The authorities were scrutinised for their inaction in light of visual evidence depicting vehicles linked to DUSU candidates.

Further Examination of Electoral Violations

In addition to the visual evidence presented, the court probed why the individuals associated with these vehicles had not been identified, especially given that candidate information had been made available via their social media profiles. The judges pressed the authorities on the presence of vehicles operating without registration plates and requested clarification on actions taken against those infringing upon court orders or the established election code.

The court underscored the possibility of postponing the elections and indicated that only candidates free from allegations would be allowed to participate if necessary. This statement emphasised the court’s commitment to ensuring a fair electoral environment.

During the proceedings, Additional Solicitor General Chetan Sharma communicated that measures would be implemented against individuals responsible for the alleged misconduct, noting that a First Information Report (FIR) had already been registered. He stated that authorities would be prepared to inform the court on the actions taken by the following day, asserting that the situation this year was markedly improved compared to previous elections.

The court will review the reports submitted by the said authorities on Friday, as it seeks to maintain order and integrity in the electoral process. This latest development raises anticipation regarding potential interventions by the court should the authorities fail to demonstrate effective oversight of the election proceedings.
