The Delhi High Court has instructed former finance secretary Subhash Garg to mute or block certain remarks he allegedly made against BJP MP Nishikant Dubey during a podcast. This directive was issued on Tuesday, following a defamation suit filed by Dubey. The court’s order comes amid concerns regarding the potential impact of Garg’s comments on Dubey’s reputation.

Justice Tushar Rao Gedela presided over the hearing and expressed the need for Garg to take immediate steps to address the situation. The remarks in question were made during a podcast hosted by a YouTuber, which has since been circulated widely across various digital platforms. The court’s intervention aims to prevent further dissemination of the allegedly defamatory content.

In addition to Garg, the court has also summoned Trinamool Congress MP Mahua Moitra, whose counsel assured the court that she would remove related posts from X that were reportedly defamatory. The court’s actions reflect its commitment to addressing issues of defamation and protecting the reputations of individuals involved.

Defamation Suit Filed by Dubey

Nishikant Dubey has filed a defamation suit seeking permanent injunctions against Garg and Moitra, requesting that they refrain from making further allegations against him. In addition to the injunction, Dubey is also seeking an apology and damages amounting to Rs 2 crore. The court has directed both Garg and Moitra to file their responses to the suit.

During the proceedings, counsel for the defendants requested additional time to respond to the allegations, arguing that the lawsuit did not accurately represent the situation. The court, however, urged them to consider refraining from further sharing the contentious content while the matter is under review.

The court acknowledged the reputations of both Dubey and Garg, emphasising the importance of maintaining decorum in public discourse. Justice Gedela remarked on the inappropriateness of using derogatory language, highlighting that such words can have significant consequences for individuals’ reputations. The court’s comments underscore the need for responsible communication, particularly among public figures.

Background of the Case

The controversy began when Dubey alleged that Garg made false and malicious claims about him during the podcast recorded on September 17. Following the airing of the podcast, the content was disseminated across platforms such as YouTube and Facebook, prompting Dubey to take legal action. Prior to approaching the High Court, Dubey had sent a legal notice to Garg on September 21.

He demanded the immediate retraction and removal of the allegedly defamatory statements. The court’s recent ruling signifies a proactive approach to defamation cases, particularly in the context of digital media, where information can spread rapidly. By requiring Garg to mute the remarks, the court aims to mitigate any further harm to Dubey’s reputation while the case is being resolved.

As the legal proceedings continue, both parties have been instructed to refrain from circulating the disputed content further. The outcome of this case could set a precedent for how similar defamation claims are handled in the future, particularly in relation to statements made in public forums such as podcasts.
