Delhi High Court Seeks ED Response on Lalu Yadav’s Money Laundering

The CSR Journal Magazine

The Delhi High Court has requested the Enforcement Directorate (ED) to provide a response to a petition filed by former railway minister Lalu Prasad Yadav. This petition challenges a trial court’s order regarding the framing of money laundering charges against him in connection with the alleged IRCTC hotel scam. The notice was issued by Justice Sachin Datta, who has scheduled the next hearing for December 3.

Details of the Allegations

The case against Yadav originates from a First Information Report (FIR) filed by the Central Bureau of Investigation (CBI). The FIR alleges that Yadav conspired with Sarla Gupta, the owner of Sujata Hotels and the wife of his close associate, Rashtriya Janata Dal Rajya Sabha MP Prem Chand Gupta, along with certain IRCTC officials. This alleged conspiracy purportedly aimed to secure undue financial advantages between 2004 and 2014.

In his petition, Yadav contends that the trial court’s decision to frame money laundering charges was based solely on the existence of related charges against him. He asserts that there is no evidence indicating his involvement in any activities connected to the alleged proceeds of crime. Yadav’s legal team describes the trial court’s order as fundamentally flawed and lacking legal grounding.

Furthermore, Yadav claims that he was never summoned by the ED for any investigation, suggesting that he has not been implicated in any activities associated with the alleged crime. His petition seeks to overturn the trial court’s ruling, which has significant implications for his political and personal life.

Trial Court’s Previous Rulings

On September 10, the trial court ordered the framing of money laundering charges against Yadav, his wife Rabri Devi, their son Tejashwi Yadav, and six others. The court noted that the allegations made by the ED, covering the period from 2005 to 2014, indicated that railway officials manipulated a tender process to award the lease of railway hotels in Ranchi and Puri to Sujata Hotels under Yadav’s leadership.

In this ruling, the trial judge discharged seven of the sixteen accused individuals. This decision followed a previous ruling in October of the prior year, in which the trial court had also framed corruption charges against Yadav and eleven others in relation to the CBI case linked to the alleged scam.

The ongoing legal proceedings highlight the complexities of the case and the various stakeholders involved. As the High Court prepares to review the ED’s response to Yadav’s petition, the outcome will be closely monitored by legal experts and political observers alike.
