Delhi Court Grants Bail to Sanjay Jain Citing FIR Delay

The Rohini court in New Delhi has granted protection from coercive action to Sanjay Jain, who is facing accusations in a rape case. The decision came after it was noted that the First Information Report (FIR) was filed five years following the alleged incident. The court issued this directive while requiring the accused to participate in the ongoing investigation.

Details of the Case

Judge Kapil Kumar, presiding over the Additional Sessions Court, rendered the decision on March 17. He stipulated that Sanjay Jain would remain protected from any police action until the next hearing scheduled for March 28. ASJ Kumar highlighted the significant delay in the registration of the FIR, stating, “Considering the attending circumstances of this case, particularly the fact that the FIR was registered almost five years after the first allegation of sexual assault, the applicant deserves the opportunity to join the investigation.”

Investigation and Compliance Requirements

The court has mandated that the accused must cooperate with the Investigation Officer (IO) and join the investigation whenever requested. Furthermore, the IO has been authorized to submit an additional response detailing any developments in the investigation, as well as outlining the justifications for potential custodial interrogation of the accused, if necessary, at the upcoming hearing.

Legal Arguments Presented

During the bail application process, the defence argued that the underlying issue stems from a financial dispute rather than the allegations of rape. Defence attorneys Pravesh Dabas and Nitesh Khapra pointed out a ledger indicating an outstanding amount exceeding Rs 40 lakh attributed to the complainant’s firm. They contended that this financial disagreement serves as the motive for filing the FIR against Jain.

Counterarguments from the Prosecution

In response, the Additional Public Prosecutor (APP) representing the state argued against the request for anticipatory bail, emphasizing the severity of the accusations. The prosecution highlighted the need for caution given the nature of the allegations, suggesting that they warrant a thorough examination and consideration of the potential risks associated with granting bail.
