Centre Issues New Regulations for Online Gaming

The Ministry of Electronics and IT (MeitY) has announced the finalisation of rules aimed at executing the Promotion and Regulation of Online Gaming Act. These regulations are set to take effect from May 1, 2026, and will lay the groundwork for the establishment of an independent online gaming authority. The move is part of a broader initiative to ensure better oversight and governance within the online gaming sector.

According to IT Secretary S. Krishnan, the regulations aim to create a streamlined process for most online games. Non-monetary games, which are not classified as real money games, will not be required to undergo registration or determination processes. This regulatory light touch is intended to encourage innovation while maintaining safety standards.

The provisions also require that esports games undergo mandatory registration as outlined in the primary legislation. The government’s approach focuses on ensuring that the majority of gaming activities can operate with minimal administrative burden, allowing the market to flourish without unnecessary restrictions.

Conditions for Regulatory Oversight Specified

While the new rules promote a deregulated environment for most online games, IT Secretary Krishnan indicated that certain specific conditions would still trigger regulatory action. The first condition is when oversight is initiated suo moto by the authority. This means that the authority can independently decide to review certain games.

The second trigger involves esports games that have been designated for mandatory registration. Finally, the central government may, at its discretion, identify particular categories of social games that could come under scrutiny, although as of now, no specific categories have been indicated.

The Ministry is keen on ensuring that this framework balances user safety with the freedom to innovate. Clear definitions and guidelines will aid both operators and users in understanding their rights and responsibilities. The overall aim is to cultivate a safe and responsible gaming environment in India.

User Safety Features Addressed in New Rules

User safety is a focal point of the newly established regulations. The Ministry has outlined explicit user safety features to protect players, reflecting a commitment to responsible gaming practices. The Act itself continues to prohibit online real money gaming, whilst fostering the growth of esports and other social gaming activities.

The Ministry previously solicited feedback from interested stakeholders regarding the draft regulations in October 2025. This outreach resulted in the collection of around 2,500 contributions, underscoring the collaborative effort involved in shaping this legislative framework.

As the implementation date approaches, government officials have expressed hope that these regulations will enhance the integrity of online gaming in India. By clarifying the rules surrounding gaming operations, the Ministry aims to create an environment conducive to both enjoyment and safety for users. The upcoming changes are expected to significantly impact the landscape of online gaming in the country.
