Apple has initiated legal proceedings against OpenAI, its associated entity, the OpenAI Foundation, io Products, and two former Apple employees. The lawsuit, lodged on July 11, 2026, in the US District Court for the Northern District of California, claims that the defendants misappropriated Apple’s proprietary information to expedite OpenAI’s ventures into consumer hardware.

The legal documents allege that OpenAI has engaged in a deliberate operation to acquire and leverage Apple’s confidential data by employing former staff members, adopting specific recruiting strategies, and establishing relationships with suppliers. OpenAI has not provided immediate commentary regarding the lawsuit.

This legal conflict represents a significant escalation in the strained relationship between Apple and OpenAI, particularly as competition intensifies within the artificial intelligence industry. The case highlights a broader struggle for dominance in the market for AI-integrated consumer devices.

Background on the Defendants

The lawsuit identifies Chang Liu and Tang Yew Tan as the primary defendants among the former employees. Liu, a past senior system electrical engineer at Apple, is accused of not returning a company-issued laptop and allegedly exploiting a vulnerability to gain unauthorised access to Apple’s internal network, leading to the downloading of numerous confidential files.

Tang Tan, formerly Apple’s vice president of product design, is also implicated for reportedly using Apple’s confidential data to provide OpenAI with a competitive edge. The allegations include Tan’s actions of emailing proprietary supplier information and industry analyses to himself prior to departing Apple.

Moreover, the allegations extend to his actions encouraging candidates to present Apple materials during job interviews at OpenAI, leading to an incident where a job applicant reportedly acknowledged not realising that such materials could be taken from Apple’s office.

Impact on Industry Dynamics

Apple has raised concerns that over 400 ex-employees work at OpenAI, suggesting a potential risk for misuse of confidential information. According to Apple, the mere employment of these former staff members does not grant OpenAI permission to utilise sensitive trade secrets in advancing its hardware projects.

The company has also highlighted instances where OpenAI allegedly solicited confidential information from Apple’s suppliers. In one cited case, a supplier executed a unique metal finishing technique under the belief that OpenAI had Apple’s authorisation, further illustrating the intertwined nature of the two companies’ operational strategies.

This lawsuit comes despite an ongoing partnership between Apple and OpenAI, which saw developments such as Apple’s integration of its artificial intelligence features into its applications, including Siri. In turn, users can access OpenAI’s ChatGPT through Siri and subscribe to ChatGPT memberships directly from their iOS settings.

Furthermore, OpenAI’s pursuit of hardware initiatives was bolstered by its $6.5 billion acquisition of the hardware startup io Products last year. Although io Products is mentioned in the lawsuit, its founder, Jony Ive, is not named as a defendant.

Earlier reports indicated that OpenAI was contemplating legal actions against Apple, including potential notifications regarding alleged breaches of contract. However, it remains uncertain whether a formal lawsuit would be pursued.
