Vande Mataram Granted Equal Status as National Anthem by Union Cabinet

The CSR Journal Magazine

The Union Cabinet, led by Prime Minister Narendra Modi, has approved a proposal to elevate the national song Vande Mataram to a status equal to that of the national anthem, Jana Gana Mana. This resolution was reached during the first Cabinet meeting following the recent election results in West Bengal, Tamil Nadu, Kerala, Assam, and Puducherry. Ministers reportedly praised the Prime Minister for what they referred to as a historic win in West Bengal.

Legal Framework for Protection of Vande Mataram

Government officials revealed that amendments to the Prevention of Insults to National Honour Act will be enacted to protect Vande Mataram similarly to how the national anthem is safeguarded. Once these changes are implemented, any act of disrespect or obstruction during the singing of Vande Mataram will be classified as a cognisable offence. This amendment is expected to create a robust mechanism for enforcing respect for the song.

The current law punishes insults towards the national flag, the Constitution, and the national anthem, imposing penalties that may include imprisonment, fines, or both. With this proposed amendment, violations involving Vande Mataram could incur comparable legal consequences. The law specifies that individuals who intentionally disrupt or prevent the singing of the national anthem may face imprisonment for up to three years or fines, with repeat offenders at risk of a minimum one-year jail sentence.

This broader application of legal consequences to Vande Mataram is anticipated to impact how respect for national symbols is enforced across the country. The Cabinet’s decision is intended to reinforce the significance of both the national anthem and Vande Mataram in India’s identity.

Cultural Importance of Vande Mataram

Vande Mataram, written by Bankim Chandra Chattopadhyay, is a historical piece that played a significant role in India’s fight for independence. As the country celebrates the 150th anniversary of this iconic composition, the Cabinet’s resolution adds symbolic significance to its recognition. Granting Vande Mataram equal status aligns with the cultural values and historical importance it holds in Indian society.

Past discussions in Parliament have previously highlighted the need to grant equal status to Vande Mataram, particularly during a special session in December last year that coincided with its anniversary. Similar amendments, which aimed to prevent disrespectful treatment of the national flag, were adopted in 2005, demonstrating a long-standing commitment to preserve national symbols.

The proposed amendment is expected to be presented in Parliament shortly. If ratified, it will signify a crucial shift in India’s legal framework regarding its national symbols, potentially reshaping the legal landscape surrounding cultural identity and national pride.
