US-Canada Trade Discussions Heighten as Trump Prepares to Enforce 50 Per Cent Tariffs

The United States and Canada are engaged in heightened discussions to avert a potential trade dispute, as President Donald Trump is preparing to implement 50 per cent tariffs on Canadian imports valued at $20 billion starting from 12:01 am on Wednesday. These tariffs would affect a wide range of products, including hockey sticks and tongue depressors, signalling a significant escalation in tensions between the two countries that have historically been close allies and substantial trading partners, despite periodic trade disagreements.

This specific instance of tariffs comes at a time when relations between the two nations have become strained. Previous cooperation on various issues, such as access to Canada’s restricted dairy market and softwood lumber, now appears overshadowed by the looming threat of financial penalties. The nations share an undefended 5,525-mile border, with approximately 330,000 individuals and $2 billion worth of goods crossing it daily. Additionally, around 800,000 Canadians reside in the United States, underlining the importance of maintaining a strong bilateral relationship.

The Canadian public has expressed growing frustration with Trump’s remarks and actions regarding trade, particularly his suggestion that Canada could be absorbed as the 51st American state. A petition calling for the expulsion of US Ambassador Pete Hoekstra has gained nearly 218,000 signatures since July 21, accusing him of normalising Trump’s controversial statements.

Negotiations Underway as Deadline Approaches

There are also political considerations for the Trump administration ahead of the upcoming midterm elections in November. With American voters already concerned about rising living costs, imposing additional tariffs could be politically risky. According to Ryan Majerus, a partner at King & Spalding and former US trade official, both countries are eager to avoid the introduction of tariffs, indicating a mutual interest in seeking an alternative solution.

Washington reportedly wants Canada to increase its purchase of US military equipment, such as F-35 fighters, as well as participate in Trump’s “Golden Dome” missile defence initiative. Canada is advocating for relief from existing US tariffs on steel, aluminium, and softwood lumber, which the US argues are subject to unfair government subsidies.

Implications of the Tariff Incursion

President Trump has made tariffs a central aspect of his economic strategy as he aims for re-election. After imposing significant import taxes on nearly all countries last year, his administration faced legal challenges, with the Supreme Court ruling that he had exceeded his authority. Consequently, he implemented import taxes on 59 countries and the European Union, citing their failure to regulate goods produced through forced labour.

In July, Trump invoked Section 338 of the Tariff Act of 1930 to target Canada specifically, imposing 50 per cent tariffs on selected products that account for approximately 5 per cent of Canada’s total exports to the US. This specific provision has not seen prior utilisation, presenting a novel challenge for both countries, especially in the context of the renegotiation of the US-Mexico-Canada Agreement.

Trade experts suggest that the looming tariff threat may provide leverage in the ongoing negotiations surrounding the agreement, with Christopher Gundermann from the Centre for Strategic and International Studies noting the complexities involved in renegotiating trade terms under current circumstances. However, Canada’s government must navigate public sentiment carefully to avoid appearing weak against the backdrop of international pressure from the Trump administration.
