UN Demands Release of Palestinian Doctor Amid Torture Concerns

The CSR Journal Magazine

The UN Working Group on Arbitrary Detention has raised alarms regarding the life of Palestinian doctor Hussam Abu Safia, stating he is in imminent danger due to his current detention by Israeli authorities. His family, alongside his lawyer, has emphasised that he is allegedly facing serious health risks, reportedly having exhibited signs of torture during his time in custody.

The UN rights organisation is advocating for Abu Safia’s immediate release, labelling his detention as “arbitrary” and in violation of multiple provisions outlined in both the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights. They stated that the appropriate remedy would be his release and compensation, in accord with international law.

Background of the Detention

Dr Hussam Abu Safia was serving as the director of Kamal Adwan Hospital in Gaza when he was detained by the Israeli military along with other medical personnel and patients in December 2024. Since his arrest, he has been held without charges, raising concerns about the legality of his imprisonment and the treatment he has received while in custody.

Prior to his detention, Abu Safia was a well-respected advocate for the healthcare sector in Gaza, a region significantly impacted by ongoing conflicts. He continued his medical practice despite experiencing personal tragedy, specifically the loss of one of his sons in an Israeli drone strike. His commitment to his patients and community has been recognised by many, making his detention particularly controversial.

Reports from his lawyer, Nasser Odeh, suggest that Abu Safia’s health is deteriorating rapidly, with claims of daily abuse and mistreatment. Rights groups have corroborated these concerns, stressing the importance of his immediate release in light of the torture allegations. The situation has highlighted broader issues regarding the treatment of detainees in Israeli custody.

Reactions and Responses

The Israel Prison Service has not issued a response to the latest claims regarding Abu Safia’s conditions while imprisoned. Previously, they have dismissed allegations of mistreatment involving him and other medical workers, asserting that all detainees are treated in accordance with the law.

The Israeli Supreme Court has also refrained from commenting on the appeals for Abu Safia’s release, leading to further frustration among his family and advocates. The silence from judicial authorities has raised questions about oversight and accountability in cases of alleged arbitrary detention.

The UN Working Group has indicated that Abu Safia’s case is part of a troubling pattern, suggesting that his situation may reflect a systematic practice of arbitrary detention occurring within Israel. This alarming trend underscores the need for international attention and intervention to safeguard human rights.
