PIL in Supreme Court of India Seeks Biometric Voting to Curb Electoral Malpractice

A Public Interest Litigation (PIL) has been submitted to the Supreme Court of India, urging the Election Commission of India (ECI) to adopt a biometric identification system using fingerprint and iris scans at polling stations. The aim is to address and prevent electoral malpractices such as duplicate voting, impersonation, and ghost voting ahead of the upcoming Assembly elections. The petition was initiated by advocate and social activist Ashwini Kumar Upadhyay, citing Article 32 of the Indian Constitution to highlight ongoing issues with bribery, undue influence, and personation in the electoral process despite existing safeguards.

Call for Enhanced Voter Authentication Measures

The petitioner has requested that the Supreme Court compel the ECI to implement biometric authentication to ensure that only eligible voters can cast their ballots in the upcoming elections. The plea emphasizes the necessity of reinforcing the principle of “one citizen, one vote” and posits that the current voter verification methods, which primarily rely on voter ID cards and manual checks, are inadequate. These systems are susceptible to misuse due to outdated photographs, administrative errors, and the lack of real-time validation, which can lead to fraudulent voting practices.

Constitutional Authority for Technological Improvements

The petition underscores that biometric authentication, being unique and non-replicable, has the potential to significantly mitigate impersonation and multiple voting. It cites the constitutional obligation to conduct free and fair elections, stating that the ECI holds the authority under Article 324 to implement technological advancements in voter identification. The petition also mentions that the ECI has the capability to amend existing regulations to enhance voter verification processes.

Addressing Issues with Current Electoral Processes

It is further contended that biometric verification would be particularly beneficial in resolving challenges concerning migrant voters and eliminating duplicate entries on electoral rolls as well as addressing the problem of ghost voters. The proposed biometric system aims to create a real-time audit trail, thereby improving transparency and accountability within the electoral framework.

Alignment with Existing Identification Frameworks

The petitioner argues that the adoption of such a biometric system would also harmonize electoral processes with the current Aadhaar-based identification systems and modern technological standards that are already being used across different sectors of governance. Moreover, the petition points out that a representation was made to the ECI on March 28, 2026, requesting similar electoral reforms, yet no action has been taken, prompting the need for Supreme Court intervention.

Request for Further Directions

In addition to the main relief sought, the petitioner is seeking any additional instructions from the court that would aid in ensuring the conduct of free, fair, and transparent elections throughout India. This PIL underscores the urgent need for reforms in the electoral process to safeguard democratic integrity and enhance voter confidence.
