The tragic collapse of a building in Satya Niketan has sparked wider scrutiny by the Supreme Court regarding the safety of unauthorised paying guest accommodations across Delhi. This incident was introduced into ongoing legal proceedings stemming from the Loknathan vs Government of Tamil Nadu case.

In it, the court-appointed Amicus Curiae, Senior Advocate Ajit Kumar Sinha, included details of the collapse in a status report. The court has been previously informed about similar safety violations and the construction of buildings without requisite approvals.

Details of the Building Collapse

The multi-storeyed building, known as ‘Hostel Days’, collapsed on September 6, 2026, around 1:30 pm. This structure served as boys’ accommodation and was built on a site measuring approximately 55 square yards. It featured a basement and four additional floors. Tragically, seven individuals lost their lives, while others were rescued and transported to hospitals.

Reports indicate that construction or renovation work was underway at the time, with preliminary investigations suggesting issues in or near the basement. Local sources also reported water accumulation in the basement prior to the collapse, though the specific cause of the incident is still under investigation.

The Delhi Police has since filed a case against the owner and others, citing culpable homicide, negligent conduct, and public safety endangerment under the Bharatiya Nyaya Sanhita. The owner was apprehended in Rajasthan, with additional family members also taken into custody as part of the ongoing investigation.

Regulatory Concerns and Legal Proceedings

This unfortunate event brings to light serious concerns regarding safety and compliance with building regulations for paying guest accommodations in areas catering to students, particularly in and around Delhi’s educational institutions. The region has become a significant hub for student housing, characterised by a high density of PG accommodations, hostels, eateries, and various commercial enterprises.

The Amicus Curiae highlighted that the Supreme Court had previously expressed apprehension about unauthorised constructions and deviations from approved plans in cases like Rajendra Kumar Barjatya vs Uttar Pradesh Awas Evam Vikas Parishad. The court had issued directives aimed at ensuring stricter adherence to building regulations. Concurrently, the Delhi High Court is also scrutinising the regulations governing PG hostels.

It has requested specifics on the legal frameworks for such establishments, alongside conducting inspections to ensure compliance with plans and relevant bye-laws. While inspections have been conducted in neighbourhoods such as Lajpat Nagar, Saket, and Malviya Nagar, Satya Niketan has not yet been part of this exercise. Consequently, the current findings from the building collapse have prompted calls for more extensive inspections across Delhi.

Call for Comprehensive Safety Inspections

The Amicus Curiae has advocated for a more expansive, time-sensitive examination of paying guest accommodations, private hostels, and similar housing options for students throughout Delhi. These proposed inspections would focus on validating sanctioned plans, evaluating actual construction against approved designs, basement alterations, land use, and checking structural, fire safety, and escape route conditions.

This incident is likely to broaden the scope of examination regarding safety and regulatory compliance within student housing across the capital. Further directives from the Supreme Court are poised to shape the approach and timelines for the needed inspections, ensuring that future tragedies are prevented.
