Mumbai Court Denies Stay on Release of Shahid Kapoor’s Film ‘O’Romeo’

A Mumbai sessions court has dismissed a plea seeking to block the release of Shahid Kapoor’s upcoming film O’Romeo. The request was filed by the family of the late Hussain Ustara, who alleged that the film misrepresented his life and tarnished his reputation. The ruling allows the film to proceed with its scheduled release on February 13.

Plea Rejected by Court

Additional Sessions Judge HC Shende denied the motion filed by Sanober Shaikh, Ustara’s daughter, noting that the observations made in the order are prima facie and will not affect ongoing civil proceedings.

The judge clarified, “The Notice of Motion is dismissed. It is clarified that the observations made in the order are prima facie in nature and shall not influence the final adjudication of the suit.”

Claims of Misrepresentation

Shaikh, represented by lawyer DV Saroj, argued that the film depicted her father as a gangster, contradicting his real-life role as a journalist and informant who worked closely with Mumbai Police and the Intelligence Bureau to combat criminal activities.

The petition highlighted that Ustara faced constant threats due to his work, and even requested a bullet-proof jacket, approved by the Commissioner of Police in 1994.

Alleged Conflicts with Criminal Gangs

The filing also mentioned Ustara’s confrontations with Dawood Ibrahim’s D-Company, asserting that he had been a significant obstacle to organized crime operations. The family sought a stay on the film’s release and requested a pre-screening by a court-appointed commissioner or an independent party to ensure accurate depiction.

Court’s Decision and Implications

The court’s dismissal allows O’Romeo to release as planned, despite the family’s concerns. Legal experts note that the judgment reinforces the principle that artistic expression in films, especially fictionalized accounts, is protected unless proven to be maliciously defamatory. The civil suit regarding the portrayal of Ustara’s life continues, and any final rulings could still impact future screenings or adaptations.

Shahid Kapoor’s film, directed by a prominent filmmaker and backed by major production houses, is now set to hit theaters nationwide on February 13, drawing significant anticipation from audiences and fans.
