Trinamool Congress Member of Parliament Mahua Moitra has received interim protection from arrest until August 31, following an order from the Calcutta High Court. This decision comes after a Krishnanagar court issued an arrest warrant against her due to alleged non-compliance with court summons.

The order was given by a division bench comprising Justice Debangshu Basak and Justice Aryak Dutta. The bench instructed that no coercive measures should be enacted against Moitra until the next scheduled court hearing on August 27. During this upcoming session, Moitra’s petition contesting the arrest warrant will be reviewed.

Moitra approached the High Court after the judicial magistrate of Krishnanagar’s third court issued the warrant on August 19. This action was prompted by her purported failure to adhere to multiple directives mandating her appearance in court.

Background of the Case

The proceedings leading to the warrant began with a complaint filed by Chaina Nandi and five others, where they accused Moitra of making derogatory statements concerning various sensitive subjects. These include comments targeted at the Union Home Minister, the armed forces, and Hindu religious beliefs, such as the use of the Tulsi Mala. The complainants claimed that her statements were disrespectful and detrimental to their religious sentiments.

In her defence, Moitra stated that her absence from court on prior occasions, specifically August 4 and 12, was due to her obligations in Parliament, as well as a boycott declared by lawyers at the Krishnanagar court. Moreover, when Moitra was instructed to appear on August 18, she asserted that she was still in Delhi and her legal representative had requested an exemption from personal attendance.

Despite these circumstances, the court mandated her appearance the following day, which allowed her less than 24 hours to travel from Delhi to Krishnanagar. Consequently, Moitra’s attorney sought a ruling on the exemption request, but the court opted to issue the arrest warrant instead.

As part of the earlier proceedings in Krishnanagar, the court directed that a report on the execution of the arrest warrant be submitted by August 28. The recent interim order from the Calcutta High Court serves to temporarily shield Moitra from any potential arrest until the case is heard again.
